Lawyer sent everything except I94

hello I am trying to adjust my status. i RECENTLY married my husband. I have been out of status for 7 years now, I arrived HERE with a tourist visa. My lawyer took copies of my passport, and my sisters i94 (i came to the USA with her) he did these things because i LOST my i94. Would they deny my application because I did not have the money for the replacement? Please help?

I do not know that they will deny you outright but they will at least send you an RFE or ask for it at the interview. Your I-94 proves you entered the country legally. I suggest you work on getting the replacement now because it can take awhile and once they ask for it, you'll only have a limited amount of time to produce it or you will be denied.

11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

Well I could tell from personal experience that if your i94 is not on file you should request a copy. If you by any chance dont have that on order it could dely your case severely. I applied almost 6 months ago had my interview 2 months ago and because my i94 was not in order it delay my case.

Timeline

They didn't deny mine. Came here 1997 on tourist visa when I was 7. Overstayed my visa and my parents lost my I-94. Submitted a copy of my entry stamp in my passport with my package (advice from googling). Didn't want to pay for I-102. No RFE. The IO at my interview did ask about it. I told her my parents had lost it and showed her my entry stamp. She also asked me if I remembered entering the country. I told her what I could remember and that was it. Green card in hand.

Just to be clear...the lawyer made it clear that the I-94 he included in the package was your sister's, right? He didn't imply by omission that it was yours?

How, when, and where you entered the U.S. can be deducted from the entry stamp in your passport.

Some I.O.s are more lenient and won't request that you file an I-102, others may request you to pay for a replacement of the I-94. Frankly, the worst that can happen is that you will have to spend the money on one, so there's really no need to spend $330 upfront "just in case."

If it was much less money, I'd suggest to just do it, but in this case my thoughts to you is that you roll the dice.
