Please tell your husband to file form 1040x (Amended tax return for Federal and his State. If he is in CA, he needs to file 540x for the state. If he is in a different state,then he need to file the appropriate one for that state.Good luck. You would need copies of tax returns when you go to American Embassy on Roxas Blvd. in Manila when you go to your interview. Good luck.

hi jona, you mean to say that if he file that form 1040X there is a possibility single status he file it will change in to married ?

Be aware it is not just fing the 1040X form to amend your status from single to married. Please read the instructions before doing it, unless you are having a tax advisor prepare it for you (I still suggest you read the instructions)

Actually filing single vs married,,, the IRS could probably care less.... As you will be taxed at the higher single rate.

As far as immigration,,, I don't expect it would cause a denial,,, IF they even knew about it... As your explanation

makes some sense... No ssn,,, how to file married...

That given,,, I do like some commments by others,,,, once you get your ssn,, file an ammended return,, and get an

additional tax refund,, for the lower married filing jointly,,, tax rate.

My two centavos,,, About all it's worth.

we talk to my husband and she told me that he put a status in single because i don't have SSN yet,,,,!!

now we argue & he told me what he will do and i told him i cannot do anything but to wait what will be the result and i will prepare my self what will be happen during my interview coz im sure this is the big mistake we done,, and i will accept what ever will be the result,,

right now i cannot stop my tears :crying:

Are you still in the Philippines?If you do then your husband can still put single in his status...My husband did that also before but I don't have any problem with my Visa.

Per the IRS website:

Your marital status on the last day of the year determines your marital status for the entire year.

There is an option to file your taxes as married filing separately if your spouse does not have a SSN OR ITIN to file jointly, and you can file an amendment later with 1040X if/when you want to file married filing jointly after your spouse has their SSN. (I suggest doing this rather than filing single, then amending it later because you have to explain why you chose single when you can use married filing separately).

One US government agency not to mess or play ignorant with is the IRS, because they dont care if you don't know the rules (this is just a word of advice).

yes, i am still in the Philippines,,,we just receive are NOA2 recently,,!! did the embassy ask your status regarding that single even though your married ? really it will not effect our processing time? honestly right now i cannot sleep because what happen IRS, i cannot stop thinking about it,, during your interview did the consul ask to your IRS?

Suggest to pursue an ITIN (use form W-7), prep a paper version of the 1040X, you sign paperwork, and your husband submits all to the special ITIN address in Austin Texas.

The consulate don't asked me about the IRS status of my husband.Don't worry everything will be alright.
