A daughter and her family was petitioned by USC mother, I-130 is approved and the is at NVC waiting for available immigrant visa number. The daughter is now pregnant. The child she will have was not included in the original I-130 petition. What are the procedures to bring this future child to the USA along with his parents?

Who is the primary beneficiary of the petition? If the daughter or her husband are the primary beneficiary then the child can be added, as Aaron indicated. If the daughter is a derivative (i.e., one of her parents is the primary beneficiary) then the child cannot be added as a derivative. Only spouse and minor unmarried children of the primary beneficiary can have derivative status.

hi I am new to the visajourney I just have a question I am a perminant resident holder I applied for my wife I 130 5 month ago and 2 month ago thy approve my I 130 form and next month I have my ceremony for my citizenship I know that I can upgrade my case after I get my citizenship wich is next month but my question is I will be having a babay next month as well I don't know if he will be born before I get my citizenship or after I get my citizenship can u tell me what to do in both situations please ?

If the child is born after you become a citizen, the child is most likely a US citizen from birth. The child is a US citizen from birth as long as you've been physically present in the US (in any status) for 5 years (including 2 years after you turned 14) before the child's birth. In order to naturalize, you had to have resided in the US for 5 years as a permanent resident, and perhaps you had some time in the US before being a permanent resident; so unless you took a lot of trips outside the US during your permanent residency, and was never in the US before becoming a permanent resident, I would say chances are that you meet the condition.

If the child is born before you become a citizen, you need to petition the child separately on another I-130.

I took a trip of 2 month and 13 days to get married since I came to the usa 07/07/10 do u think that I meet the requirments if the baby born after the citizenship ?

But you've also also been to the US before you became a permanent resident?

Anyway, if your child doesn't get citizenship at birth, you can still petition for him/her.

hi

i am a new member and have a question.

i filed up a petition for my wife since 2012 and her case is in process with national visa center.

my daughter was born in march 2013 i called national visa center to add her to my wife case

nvc asked me her birth certificate but after one yers they send me back that birth certificate saying that my daughter require her own

individual petition in order to immigrate to us.

my daughter is only 2 years old and i already paid the fees for her and may wife at nvc $230 each.

my wife can't leave her daughter alone if she got the visa

what should i do in this situation to bring them both at the same time, please help me.

Hi,

You are a US citizen. When a USC petitions for a spouse in an Immediate Relative case, only the spouse can get a visa. Derivative beneficiaries are not allowed. You can not add your daughter to the case for your wife. Your case is different from the OP's which is an F3 family preference case where derivative beneficiaries are allowed.

You have to file an I-130 for your daughter. You can ask for an expedite. Slow down the case for your wife by taking your time to send in the requested documents.

Hello I have a general question about Report Birth Abroad my question is, i got my citizenship on 08/05/2015 and I live in USA now and my wife lives in Sudan I already apply for her form I-130 and it is approved and she is pregnant and her due is on the month of August and I lived in the United States for 5 years and I can prove it of course I am not going to go to Sudan till November so can I report the Birth Abroad from the United States online and if you don't mind can u tell me what do I need to do and walk me through the steps
