Upgrade I-130 petition from F2A to IR issue!!!

Hello,

I was a LPR when I filed I-130 for my wife. The receipt date is july 12th 2011. I became a citizen on feb 6th 2012. I have called USCIS and upgraded my petition from F2A category to IR and they sent me an acknoledgement on 12th feb 2012. Right now I am worried since the processing date for USC wife is augest 2nd as of today and mine is not approved yet. The processing date for F2A is june 1st and it was only 1month and 12 days away from approval. now I am worried once I upgrade my petition, will USCIS consider it as a new application and process it based on feb 12th for IR when i updated my application...I am worried coz i will lossing many months by just upgrading the petition...Any one have idea how they will process the case if i upgrade, will I loose the months again, that I waited already?...very tensed..plzzzz help...god bless

my understanding is that your NOA1 date remains the prevailing prioroty date... so you should be expecting that once the USCIS gathers up your case and they realise that you are now a USC you will be getting your NOA2 soon.

I would call them in a week or so -

I'll let others chime in - but i think im correct in my thinking as this is what my attorney told me also - and the sole reason for my filing for I-130 now and not waiting til later this year for my citizenship.

Case upgrade request sent via email April 3 2013

Case upgraded by NVC from F2A to CR1 April 19 2013

Interview June 6th 2013 - APPROVED - case upgraded to IR1 at time of interview based on time married

Visa in hand June 10th 2013

IV fee paid using ELIS June 17th 2013

POE Houston July 15th 2013

GC arrived in mail Aug 12th 2013

SSN card arrived in mail Aug 19 2013 (1 week after applying)

I believe once filed F2A then notified of LPR change to a USC the F2A status immediately changes and a new date is established.

you getting your citizenship is the best thing that can happen to your wife' petition. as an LPR she probably wnt be getting her visa in another two years or more but now, rest assured that before the year runs out the process will be over unless there is another cause for delay. your peition will still have the first PD. Give them some days to recocncile ur file and then follow up...from then you can sail on.

10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

Are you sure a new date will be established???...then what is the point of upgrading the petition. I could have filed after I became a citizen rt, if a new date gets established!!!...

I believe once filed F2A then notified of LPR change to a USC the F2A status immediately changes and a new date is established.

I called USCIS and people are telling different stories each time. some says they process the cases as they received doesnt matter even if I upgrade or not...if upgraded it will be faster...

one other person told since upgraded you will put to the back of the queue....

I dont know which one I should beleive. I called USCIS again adn they put a service request saying that my case is out of processing time and they said I will get an update in 15 days... I am worried a lot now...:(

You should be ok, don't to worry.

Your status update to IR1 or CR1 by getting citizenship is going to help you big time in NVC processing.

NVC is the one who will issue visa number after USCIS approval and being US Citizen, you will get the visa number quickly, you don't have to wait for waiting period like F2A category beneficiary has to wait.
