Social Security # confusion

I am back asking for help again on what to do next. We filed for the AOS on Dec. 29th and so far we have gone for the biometrics appointment. He has ben here now about 7-8 months and hasn't been able to work yet which is driving him crazy! We are now waiting for the EAD but we have a separate problem. There was a mix-up when he first got here and the Social Security office didn't give him a social security number. He went back when I saw that he needed it ASAP but by that time he was within 2 weeks of the 90 day period of the K-1 visa so they denied him again. I went back when I changed my name and I talked with them again. They looked into it, sent an additional request and we just got the 3rd denial. It says 2 things: You have not given the documents to show lawful alien status and the immigration documents you have provided are expired. When you are able to provide documents that show current work authorization we will be able to process a Social Security number application.

I have 3 questions now:

Does that mean that when he gets the EAD he can get a SS number?

If not, is the EAD useless without a SS number?

Is there anything else I can do?

To be honest, we are both getting exasperated with the process and every denial is a slap in the face. It's hard to be positive. It's also hard for him to sit at home all day alone and for me to continue to pay all the bills myself. If anyone has had a similar situation or an idea of what to do, please let me know.

Because your K-1 is invalid so they can't give you SSN. You will be able to get a SSN as soon as you have EAD on hand (it is your right so there is no way they can deny you when you have all documents.) Good luck.

Yes, the EAD is useless without the SSN. Yes, he can get his SSN when he receives his EAD.

Once your I-94 expires or is about to expire they (SSA) does not issue you a card, you need to provide a valid U.S document, EAD will do. There is nothing you can do right now as far as getting a SSN, he really needs to wait. He will have a Social Security Card, just not right now.

Hopefully you'll get the EAD soon, your AOS was sent a little after mine and I have the EAD approved. As the others have said, you can get SSN once you have the work authorization or greencard. If they're really stubborn at that SSA go to a different place, or email them through their website. This would probably have helped earlier to know but at least you're closer to getting it now.

K1 process, October 2010 > POE, July 2011

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)
