Hi there. I was going to immigrate to Australia but due to my health I was denied so the only option is for my wife to immigrate to the US. I was wondering, if my wife is on disability for selective mutism and depression and is currently struggling with an eating disorder, can she be denied immigration to the US?

Has her issues ever caused her to try and harm/ kill herself or others? If not, the health issues themselves should not be a problem.

However, the CO MAY ask at interview for proof that she has her health issues covered by insurance when she moves to the USA, so as to ensure not becoming a public charge.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

From what I understand, one can be found ineligible in case of a medical condition if:

- there is a communicable disease

- or there is a physical or mental disorder which may cause harmful behavior against self or others. This second limitation might apply to your wife if her depression has caused or is likely to cause suicidal behavior, or if her eating disorder is so acute that it endangers her life, so the situation will be assessed by the physician at the time of the medical examination.

It would probably be wise for her to come with evidence that she is undergoing treatment and is stable enough.

She may need to bring a letter from her doctor to the medical (once you are at this stage) outlining the issues, the treatment, and the prognosis. From what I have read from other VJers and across other forums, they are more concerned about clinical depression but nothing is insumountable. We are having the same concerns and we took advice from an immigration lawyer, would that be an option for you? I would rather seek some sort of advice on any potential issue so you can best prepare yourselves. :)
