Timeline

I sent in my husband's EAD application (765) along with the advance parole and the AOS, and on one form, (the I765) I put a typo - said he was born in 2011, when clearly he was not. (I originally thought this was USCISs error - it was not). I sent them 5 proof of date of birth documents, along with the original i485 application with the correct date, but they sent everything back saying the typo is my fault, and because of that, i have to reapply and pay another $380... Can this really be? I'm getting penalized $380 because I made one typo on the 25 odd pages of repetitive forms they make you fill out?

Now, the green card is still in process; the DOB on that one was correct. DO I just wait for the Green Card, and hope it comes before he really needs the EAD? Will it get held up until I take care of the EAD issue? Also, this process started in September, and still my GC is in "initial review" - does that sound right?

HATE THIS.

12/23/11 - NOA 2- I485 moved to CSC

12/23/11 - EAD approved

1/13/12 - EAD rec'd - wrong DOB

The EAD is free when filing based off of an I-485. I am not sure why you need to "pay another $380." You shouldn't have ever paid.

OP - If you filed for AOS/EAD/AP at the same time, the EAD and AP are free. The application is 1070 which includes an 85 biometrics fee.

If you filed for AOS in September and still waiting, something is wrong. You should definitely look into it.

You're right, i applied for everything at the same time, and I got the $380 fee waived. But now they tell me i have to apply for the AP and the EAD again, and pay the fees.

Do you think i should just make the infopass appointment and go talk to someone? Or is this something that can be accomplished by mail or phone?

You have to file again, but it is free. FIll out a new application and send in a copy of the I-485 NOA1 to get the fee waived.

ah, well that was easy: right on the instruction page, under "special instructions". Seems that i can reapply for he advance parole as well for no fee?

"If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 together with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of a Form I-485."
