That's the problem, even the eligible supplement in the N-400 is using a bunch of OR's when they really mean AND's, in terms of evidence of living together. Ha, someone should take the USCIS to court with that supplement.

Three year marriage certificate is a privilege, according to our law, you are a better citizen if you are married to one. None of that goes on with the five year. And the USCIS carries this to the nth degree. Just bring in tons of evidence, and you will be okay.

I was with my wife at her interview, her IO wouldn't even return my hello, she just wanted to see my papers. Guess they can do whatever they want to do.

Thanks so much with the info...I know, they pretty much have the upperhand. Sigh...

I wonder if she suspected that the two of you weren't living together still, with your wife being in the Philippines this year, and you mentioning you were there last year it might have sounded like the two of you are living separate lives in real life and are married only on paper. She may be suspecting that once you become a citizen the marriage will dissolve and you were staying married just to get the 3 year citizenship benefit.

Bring everything that you can to show that the two of you do live in the same place, share a life together physically, socially and financially. Be prepared to explain why you each have long absences from the other in the Philippines. The two of you definitely need to be at this interview, and no, I'm sorry, you can't make an Infopass to do this. An interview with an Immigration Adjudicator is different than a meeting with an immigration agent, so you will have to make the scheduled appointment.

Good luck. As long as you are prepared and can explain the 'red flags' she had from your initial interview, you should be fine.

Hope your interview isn't like that movie, "The Proposal", wife and I watched that. Maybe it was just as well they only wanted to see my papers, but felt at the time, should have been in there at that phase, because I was far more competent in explaining them. If they were to ask me the names of my in-laws, would be dead meat, can't even pronounce them let along remember them. But do get a refresher course when going down there and tend to use the English equivalents.

Many people come here worried about the civics tests, that was nothing to us, spent hours with my wife going over the N-400 and explaining the evidence. Got one of those folder brief case with everything organized by type for her. Ha, it was a mess when returned to me, but at least it was all there.

We considered waiting for the five year, but with severe stress with the ROC stage, decided we wanted to end our relationship with the USCIS. Five year is form, check, green card, and two passport photos.

Thanks for the reply kathryn... I did explain to her why i was there in the Philippines for 5 mos. I got laid off last April...so my wife said, atleast I have a free time already, I should go home and start preparing and organizing our Church wedding. I went back last September, then I told the IO it's my wife's turn to go to the Philippines to see what I've started and location of the Church and reception, and also because she needs to take up classes for Church. It's a requirement if you're not a citizen of the Philippines and she's a Christian not Catholic. My wife left mid November. We were supposed to spend Xmas there for the first time with my side of the family...but when she learned that I haven't heard from USCIS, she came back here before Xmas just to spend Xmas with me.

We are gathering all our docs already. So pretty much we're ready...We have documents too that had to be sent back here from the Philippines because the church asked most of it too. Like the marriage certificate , etc.

Thanks for the update and pointers. I was actually considering the 5 year Naturalization, especially after reading the interview letter again. Failur to go to interview will result to denial of application to naturalization...Very tempting, just for the sake of not going through the interview thing again. But my wife insisted to go and said, "Don't worry I'll take care of it" I just love her...really calm and stress free...that just took the stress away from me...hehehe

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
