ENTERED USA ON DEC, 19TH, 2011 AND PLAN TO MARRY A NON US CITIZEN IN USA MA

Hi Everyone:

Greetings: I have entered into USA on December 19th 2011 on Employment based Green Card. Now I am planning to get married a Non US Citizen, who is under F1 Student visa. Her visa is expiring on First week of February, 2012 and does not want to continue her studies.

She is advising me to get married in USA and submit the I-130, after she leaves the country.

My question is:

a) Is it okay, if I submit -I-130, after she leaves or do I need to wait for sometime.

Your assistance in this regard will be highly appreciate.

This story seems Odd to me. Was this a plan.

Only a USC can petition.

7/10-11/13.. Medical Exam completed@St.Lukes Clinic
1/15-16/14.. 2nd Medical exam updated
1/21/14...... k1 interview-Visa Approved
.....................................................................
8/29/14...... Submitted AOS application
10/03/14.....Biometrics
01/07/15.....Received my EAD card

01/31/15..... I got my SSN from the mail

04/20/15......AOS Interview - Approved :star:

4/24/15 .......Got the Driving Permit Card

4/30/15 .......Green Card Received :) (Exp.4/20/17)

This is not correct. A legal permanent resident may file a I-130 petition for their spouse but the visa will not be immediately available to an LPR like it is for US citizens.

OP, you are free to marry in the U.S. but because you are now a permanent resident you are looking at a 3+ years long wait for your future wife to be able to immigrate to the U.S. because she must wait for a visa to become available.

OP, you are free to marry in the U.S. but because you are now a permanent resident you are looking at a 3+ years long wait for your future wife to be able to immigrate to the U.S. because she must wait for a visa to become available.

There's a marriage to take place inbetween them two time ticks.

Were you folks planning to stay together this year? I'd dig deep into staying at university, in USA, instead.
