Hey gang!

We're preparing what we can ahead of time for when the NOA2 arrives. When it comes to filling out the I-134 and providing supporting documents, I noticed the example (question 7) mentioned "if self-employed, please provide most recent income tax, etc." Now, I am definitely the opposite of self-employed, but have only been with this company since November and before this I haven't had a real "grown-up" job so to speak, therefore a tax return seems to be in order.

Is evidence of filing for a tax return, or whatever (I'm still trying to learn what this entire tax return process is anyway) at all something that should be included in the evidence or will a letter from my employer, pay stubs, bank statements, etc suffice?

Any other advice on what documents I should include would help as well (pay stubs previous from jobs, maybe? Maybe not?).

best way to find out exactly what the embassy where she is going to interview wants, is to try to email them and ask. I emailed the embassy in bangkok and asked them what exatly they wanted for supporting documentation for the I-134 and got an email back a few days later with what they wanted to see.

A letter from your employer and pay stubs prove current income. If you have never filed a tax return before then you need a letter explaining why, citing the specific tax code that exempts you from filing. Very few people are exempt from filing a tax return though many people are exempt from PAYING income tax. Just because you would owe no tax is not a valid reason to not file.

You only need ONE year for the visa and only need ONE year for the AOS, plus give a statement of earnings for the previous three years.

Again, if she was exempt from filing for the years previous to this then write a letter stating such BUT it must cite the tax code which exempts her. Being a student does NOT exempt a person from filing income tax returns. It is very likely she owes no tax but still has to file a return.

If you find she should have filed a return for those years, you can google "1040-(year)" and get the forms. There is no penalty for filing late if no tax is owed. File the needed returns.

London does NOT require a tax return with the I-134 or a reason why you don't have one. Two good proofs of current income will do it. So when you get NOA2, gather your most recent three pay stubs and a letter from your employer and sign/date your I-134. It will be fresh information and still have time to get to the UK via snail mail before the interview.

@LorRenee: No need for past employment pay stubs or bank accounts for your London interview.

For the AOS I-864, tax information from 3 returns is asked for on the form, but only one actual return is required to be sent in. See my answer about what to include with the I-864 if you didn't have enough income to file all three years.

Awesome, I think we've hit a crossover as we're looking at the AOS stuff now as well just so we can get as much prep as possible out of the way. I've prepared a statement and we've worked out exactly how much has and hasn't been earned. Again, thank you!
