I-864, tax returns, tax transcripts.

Hello everyone :)

I'm still waiting for our NOA2. But in the meantime, I am working on the I-864 form.

Just a quick run down of my life's situation the past several years:

- I was unemployed in the U.S. from 2004 to late 2010.

- I went back to college from 2008 - 2010, graduating Spring 2010. licensed in my profession in Fall 2010.

- Began employment Fall 2010.

I only have my 2010 tax return.

I do earn above the 125% Poverty Line.

I did go to the IRS site and was only able to request for my 2010 tax transcript return. I requested 2009 and 2008, but I was give this message instead:

"A transcript is not available for the year you have requested. Please complete Form 4506-T or contact us at 800-829-1040."

Is it because I was unemployed from 2008 to 2009?

So how do I go about getting the last 3 years of my tax return or transcripts?

2003 - met online

12-09-2010 - met for the first time

12-11-2010 - engaged

06-07-2011 - married

09-27-2011 - I-130 sent

09-29-2011 - NOA1

04-04-2012 - I-130 approved

05-14-2012 - NVC Case number received

06-26-2012 - Case completed

08-02-2012 - VISA APPROVED :)

you might get a piece of paper from the IRS office, should you go in to yer local, and inquire.

Once ya got a piece of paper from that office, stating the obvious,

you should include it on yer I-864 submittal;

otherwise you can write up a simple letter of attestation that you not have taxable income those years, submit it with the I-864.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I have never filed anything other than previous year taxes (copies, I have never requested a transcript in my life LOL) and current employment/banking information.

We have successfully done this for the K3 I134, AOS I864, and DCF I864.

When you make the copies make sure that every single associated document is submitted with the 1040/EZ or whatever was filed. W-2, 1099, etc.

If you were ineligible to file previous year the instructions say what to do aka send a short letter of explanation.

Did you file a return for those missing years?

No I didn't file a return in 2008 and 2009 because I was unemployed and going to college.

I think Darnell is saying to stop by the local IRS office, and get something that says you didn't have to file a return for the missing years.

What's a NOA2?

And what do 3 years of tax returns have to do with the visa application?

What does it mean if you don't know the number above 2 and below 4? Am I a robot? Or a monkey perhaps?

NOA #2 in usually the notice of approval for a petition or application by the USCIS. I don't know if that applies in the case of DCF. When filing the I-864, (Affidavit of Support) it requires the attatchment of the last three years of copies of the last three tax returns, or transcripts to establish the income history of the (USC) sponsor. If one or more of the years includes the income of both spouses, so much the better.

If one or more of the years includes the income of both spouses, so much the better.

According to the I-864 Instructions PDF found on the USCIS Website you are only required to provide a copy of your most recent return:

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years." Page 8, first paragraph.

This is also taken from that same PDF and should be helpful for your situation:

"If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return. See "Filing Requirements" in the IRS Form 1040 Filing Instructions to determine whether you were required to file."

07/22/11 - Mailed I-130 petitions for wife and step-daughter

07/28/11 - NOA1 for both

02/21/12 - RFE for both (received hardcopy on 2/25)

02/28/12 - Responded to RFE for both(received by CSC on 2/29)

03/02/12 - NOA2 for both(received hardcopy on 3/8)

NVC: (37 days)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/26/12 - AOS bill shows paid & AOS Packets mailed for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

03/28/12 - Choice of Agent accepted for step-daughter & IV bill invoiced & paid for wife

03/29/12 - IV bill shows paid for wife & IV bill invoiced & paid for step-daughter

03/30/12 - IV bill shows paid for step-daughter & IV Packets mailed for both

04/04/12 - IV Packets reviewed. Checklist issued for Divorce Decree for my wife. Step-daughter's was accepted and her case closed

04/10/12 - Divorce Decree accepted after supervisor review & wife's case closed

04/16/12 - Expedite requested for both cases due to NVC error

04/18/12 - Expedite request approved for both cases and sent to Santiago Embassy

Embassy: (15 days)

04/24/12 - Embassy received both cases from NVC

04/25/12 - Wife went to Embassy for document review. Interview date assigned for both cases.

04/26/12 - Medical Exam for both. Result - approved.

05/07/12 - Interview date for both. Result - approved!

05/09/12 - Received both Visas

05/16/12 - POE Atlanta

if you didn't file taxes how can you get a transcript? I think you will need a co-sponsor, who has had fill out for the missing years, and for you to be in a safe place

Thank you all for your replies. I will do the best I can to submit as much as I am able to. I will write a letter stating my unemployment and college situation. I was able to find a joint sponsor as well.

@Matt & Rocio thanks for posting the paragraphs.
