I'm getting all my materials ready and I'm all done except for the financial stuff. I know I have to file the i-864 but since I am unemployed I have my sisters and father who have offered to help us. However I am confused do they complete the i864 AND i864a or ONLY the i864? Help please!

The spouse fills out the I-864. If your co-sponsor lives in your household they fill out the I-864A. If they do not they fill out the I-864. Do your father and sisters live together? If not you will probably not be able to use both.

10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM

My mother in law is my co sponsor and we live in the same household but she filled out the I-864 for us to be on the safe side. We thought about doing the I-864a but the dependants weren't adding up correctly and we read about some people having had problems with that so decided it safer to just get her to fill out the I-864 instead.

Finally time for AOS.......

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

yes we all live in the same house, well one of my sister's lives elsewhere but she has our address as her main address. does that still work? thanks!

In that case you fill out the I-864. The other members of your household can combine their income with yours to reach the poverty guideline. They must each fill an I-864a. They must share the principle residence meaning your sister who does not live there cannot include her income. Check the instructions of the I-864A for further details. She could be a joint sponsor and fill out her own I-864 but she would have to meet the poverty requirements for her, her dependents, and your spouse on her own - no combining income.

What do you mean filling both forms? the co sponsor will fill out either the I-864a OR the I-864, not both.

Who is everyone? You fill out the I-864 as the primary sponsor. If you are wanting others in your household to combine their income with yours, then they would fill out an I-864A and there is a place on your I-864 to list their incomes and add them with yours to reach the 125% mark. Your sister does not live in the same household, so she cannot fill out an I-864A and have her income used to meet the amount you need. If the co-sponsor will qualify on their own, meaning they make enough to cover themselves, their dependents and your spouse, then they can just fill out their own I-864.

Read through the instructions for the I-864 and I-864A carefully. Remember to count household size correctly. If you are over 21 and not claimed as a dependent by your father, then you are not counted in your fathers household size. Household size is not determined by how many people live in one house together.

Yes, you never count anyone twice. So, on your I-864 for #21 you would put 1 for a) which is your spouse, 1 for b) which is you, 0 for c) cause your spouse is listed in a), any children you have in d), and other dependents in e), any previously sponsored immigrants in f) and then 1 for g) which is your father if he provides an I-864A. For examples sake, let us say you have no kids, other dependents or previous I-864s... the household size would come out to 3.

Is your father married? He can also fill out his own I-864 and then if his wife has an income, she can fill out an I-864A to combine her income with his to meet the 125% requirement for his own household size. That would not include you, since you are not his dependent. Household size can be tricky and messy to deal with, but I am sure you can get it all sorted out correctly. How did it work for the K-1 interview? Did you have a co-sponsor then for the I-134? It works the same way, only with the I-864, you have the option of having a family member that resides with you combine their income with yours to meet the poverty guidelines if you don't make enough on your own.
