I've got a question about the form for a joint sponsor. The past year I didn't make enough to qualify based on my own income, and have gotten my uncle to agree to be the joint sponsor for my husband. The lawyer that my mother in law has hired is insisting that a) an uncle isn't a close enough relative to be a joint sponsor and b) he needs to fill out the I-864A. This seems to contradict EVERYTHING that I am reading. My uncle receives a W2 but is not the primary sponsor, which indicates that he should fill out the regular I-864, is this correct?

Any assistance would be greatly appreciated as I am about ready to go off on the lawyer (it's been over 10 months since we filed the I-130 and he keeps causing unreasonable delays).

maybe you'rc confused with a co-sponsor, as houshold member. does your uncle live with you? if not, then he would be your joint sponsor.

joint sponsors can be anybody who qualifies, friends, co-workers, family, neighbors, someone in another city or state. the household member on the other hand, is the one that has to fill the i864A and live in the same house.

if he is a joint sponsor, does he qualify on his own income, or would he need your aunt's income as well?

In a nutshell, the lawyer is wrong. Anyone can apply to be a joint sponsor as long as they meet the income requirements and they are a US citizen.

You are the primary sponsor, he is the co-sponsor, you both fill out I-864 and send three years of tax info (either transcripts or 1040s)

If your uncle is not part of your household he fills out the I-864. If he is including income from another source with in his household (your aunt or a cousin) The other party fills out the I-864a.

Don't forget to include evidence of US citizenship for all of you!

Lawyer is incorrect; A) your uncle CAN be a joint sponsor and B) sheeshkabelle correctly explained how the I-864A works.

Don't forget to include evidence of US citizenship for all of you!

I'm including all the paperwork it asks for, tax transcripts, copy of his W2 from last year, etc. Is there anything else I'd need to include to prove citizenship? What documents would you recommend?

My uncle does not live with me and is unmarried with no children, so it sounds like I was correct in my reading of the instructions. I'm afraid this lawyer is more than worthless. If I had followed his instructions without checking we'd be screwed, and this isn't the first time.

a. lawyer is wrong

b. I-864a only if you live in the uncle's house.

This is a great question - you should really visit http://www.visajourney.com/forums/topic/344988-nvc-filers-january-2012/ often, as there's other folk going through the NVC process NOW that have a bit of experience, can help you with your exact questions on the I-864.
