HOW LONG CAN I STAY?

Hello Friends:

I entered USA - on DEC 19, 2011 and my temporary Green Card I 551 is valid only for one year still I did not get my actual Green Card. I would like to leave the country on January 28th, 2012. Can I leave the country? How long I can stay?

What date is on your greencard? (the expiration)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She hasn't receive the actual GC yet, she is talking about the stamp in her passport. She can stay out for 1 year without a re-entry permit. But she must have actual GC in hand for my last staement to be true. If she is relying on her stamp, then she must re-enter before the expiration date on the stamp.

Yes you can travel out of country, the stamp on your passport is considered as GC. Your stamp is valid for 1 year.

You might have explain it over and over to certain airline employees as not sure how many would be aware of it.

You entered only in Dec it takes anywhere from 6-8 weeks before you will have your actual GC and with holidays it might be even little longer.

Another suggestion you might want to avoid a route with transit thru other countries and try to stick to direct flight.

No you can not leave unless you have a reentry permit. Your are on adjustment of status, if you come back you will be on a new status.

but if you have greens card,I think you can leave no more than

1 year .

but if you have greens card,I think you can leave no more than

1 year .

Of coarse he/she can leave and be easily able to return. It has nothing to do with adjustment of status.

She is not on adjustment of the status… there is no such thing.

Once she enters on CR1 she gets a stamp on her passport until actual card goes thru production and shipped, but the stamp is considered as GC for all the immigration purpose.

She doe now requery any re-entry stuff, re-entry is only required if one is going to stay out of country for more than 1 year.
