okay so im 17, and my birthday is January 13, so its only two weeks away. could i send it in now? or do you think they will reject it? im so confused :(

also, my fiance is coming to see me a few days after my birthday, would that be okay? even though when i sent it in only a few weeks prior it says he isnt in the country?

and if in the case of them returning it, if he is in the country when i re-send it in, would i have to state that he is in the country? or not? PLEASE HELP

This was covered many times in your PRIOR posts about you having to be able to legally marry at the time you file.

So... If you are NOT legally able to marry at the time you file due to your age your petition will be denied. You will lose your $340 petition filing fee and you will start all over again with having lost months of time waiting...

You must both be legally able to marry in your state on the date USCIS receives it. If you're legally able to marry at age 17 then you can send the petition. If you need parental consent to marry at age 17 then you can send the petition along with a notarized letter of consent from your parent. If that isn't going to happen, are you just don't want to bother with it, then just wait until you're 18.

If he's in the country at the time you send the petition then say so on question 12. Don't ever lie on any form or document you give to the US government in this process. It can come back to bite you hard. Write "WHTI" in the box for question 12 - it means "Western Hemisphere Travel Initiative", which is the program that Canadians use to visit the US without a visa. This will explain why you aren't providing an I-94 number in the boxes below that. Canadians don't get an I-94 unless they're entering the US with a visa.

so i couldnt even get a notarized note from my mom saying i can marry to help it? and with my birthday being so close do you think they would be okay with it? thanks.

If your state's law says you are legally able to marry at 17 then you will not need parental permission. If the law in your state lists legal age of marriage at 18 you will need parental permission.

Your birthday is in 2 weeks. Best to wait until you are 18 and file with the knowledge that you won't be denied.

Just out of courisity, how will you qualify income wise for the I-134? I assume at 17 you are probably still in school or just starting out in the work force.

Sorry that I assumed we had discussed your age in a prior post. Recently there was a young lady in a similar situation and I assumed it was you. You might want to do some forum searches where underage petitioners have dicussed exactly what you are asking.

Here are the age requirements for your state:

Under 18:

If you are 16 or 17 years of age, you will have to provide a copy of your birth certificate along with some other sort of identification showing your date of birth. You will also need to have the sworn consent from each parent, each legal guardian or a judge - in person - before the county clerk at the time of application. Your parents or guardians will need to provide identification like a driver's license, state identification card, Illinois Department of Public Aid card, or passport. If your parent is deceased, you will need to show a death certificate or proof of guardianship, or a court order waiving consent. A legal guardian will also need to show a certified copy of the guardianship papers. If you are under sixteen (16) years of age, you cannot get married in Illinois.

According to what I've pulled up from an internet search, in Illinois you need sworn consent from both parents, or whomever is your legal guardian, in order to get married if you're 16 or 17. That consent must be given IN PERSON in the county clerk's office, and the parent's must prove their relationship to the minor child, or the guardian must prove they have guardianship. I presume this is intended to prevent someone from forging a signature on a statement, or getting some random adult to present themselves as the person's legal guardian.

I wouldn't be surprised if USCIS asked for a declaration from your county clerk's office that both of your parents appeared in their office and gave their sworn consent. Do you really want to go through all of that just to save two weeks?

but no im currently taking CNA classes though, and plan on working just part time as a CNA. but i can have a co-sponsor right?

You and your joint sponsor will both fill out an I-134. You'll also both submit your most recent tax returns, and evidence of current income. Your joint sponsor will also need to submit proof that they are a US citizen or permanent resident.

The I-134 is submitted at the visa interview.

i was meaning to respond to you sooner, and say thanks! and that you have been very helpful!

and hmm okay, i wont have any tax returns to send in due to me just getting a job... so. what do i do?

and okay, so we both fill out the i134? does my sponsor do anything different than the petitioner?

and one more question, what if my co sponsor doesnt have the most recent tax return?

im so scared they are going to deny us because of this :(

Wait till your 18. Less paperwork and trouble. It is only 2 weeks. If you cannot wait 2 weeks then you will really have a hard time waiting for the petition to be approved. Do you know how long this process can take?

Plus once you file the I-129 he might not be able to enter USA due to the petition. So, you may not see each other for 10 months if it is approved.

How did you meet?

How long have you spent together in person?

What proof do you have of your relationship? Phone bills, pics, travel tickets, passport stamps?

Remember your co-sponser has to make above the poverty line for his own family and your fiance. Currently it is about 18,400 for 2 people.

How old is your fiance?

What will he do to support you? He will not be able to work until months after he comes here. Sometimes it is better to get married then apply for CR-1 just so he can work soon after arrival.

The questions I asked are questions you will be asked on one form or in interview.

As long as he brings proof of ties, he shouldn't have a problem visiting the US. :) make sure you research proof of ties so you guys are prepared, because altho we are neighbours, he can still be denied at the border. You can PM me if you want help with this. good luck hun! :)
