Hello everyone

I am from Europe and have come to the states on VWP to visit my boyfriend, whom I have been with for two years. He proposed in November and we got married in December.

We have been reading the forums trying to find as much information as we can on the process. We have gotten all the forms that we are going to need, thanks to http://www.visajourney.com/content/i130guide2, which has been helpful

Now we are dealing with all the forms for AOS and have a few questions regarding filling out the forms.

1. I am in the process of getting my passport name changed to my husbands, should I use my maiden name on the form or use his last name

2. On a number of forms, it is asking for an I-94 number, however since I came in on the VWP I do not have one. I have seen from a few posts that people have mentioned to use the ESTA number, is that something we should do? (also use in the Esta number in the nonimmigrant visa number spots of the forms?)

1.Use the name that you want to change to, if you want to have your husband last name, then fill the form with that. And fill the form that asks for other names use with your maiden name.

2.I don't have knowledge about this.. hope the next one will tell you.

In the United States, getting married is a legal way to change one's family name, if desired.

Husband and wife can choose to either use their spouse's name, or hypenate their name, or use both, or do nothing. Since changing names always implies having to get lots of new documents, be sure what you want before taking this step.

1) If you desire to change your name, then use this name to fill out the forms at AoS. The name you use is the name your Green Card will be issued in. There's no way to do this later, unless you are willing to spend $450 on a new Green Card. Keep in mind, the Green Card is the master document. It's the one document you will use to get your SS card, your driver's license, and most likely your new passport. Speaking of which, do NOT get a new passport before you are done with AoS. The I.O. wants to see the passport you entered the United States with. Especially since you do not have an I-94, the entry stamp in it is your only proof of how and when and where you entered the United States.

2) Since you didn't receive an I-94, and the I-94W is electronic now, I would just write N/A in it.

Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . Thank you all for your help!

There was so much going on for the Holidays we weren’t able to respond sooner. I did enjoy my first Christmas here in America a lot :), especially the warm weather here in Florida!

I do have additional questions though. Due to holidays was only able to get a doctors appointment after the new years. Is it ok to send the medical examination paperwork later on or does it all have to be together with the big packet?

Both my husband and I recently graduated from college so his mother will be our affidavit of support. Up until last year she claimed him as a depended for college expenses. Since they are still listed in the same household, does he need to fill out the I-864 and her the I-864A or do they both just fill out the I-864?

The medical exam needs to be done beforehand and submitted with the packet.

If your mother-in-law still lives in the same household, he files an I-864 and she files an I-864A. If he has since moved out, they both file I-864s.
