Hi! I entered the country with a K1 visa in October and my I-94 will expire in January. My fiance and I got married within a week, but for various reasons we haven't been able to file. We are planning on filing by Monday, but I have a few questions. I hope that they are simple for the very smart VJ community.

1) As I understand it, once you get married within the 90 days you don't have to file before the I-94 expires. I am worried about that, just in case we don't meet the deadline.

2) Is the supporting evidence of ongoing relationship supposed (joint lease, bank account, photographs, etc) be sent with the package or presented at the time of the interview?

Here's hoping you can help me! Thank you so much in advance.

Nothing will happen if you don't meet the deadline except you will be out of status. That means you could be detained by ICE but it's unlikely and even if you were you would probably just be told to file for AOS. The closer to the 90 days you can file, the better.

As an AOS applicant from a K-1 you don't have to include your evidence when filing if you don't want to, but you can.

1) There's no "AOS timeline". However, the sooner you file, the better.

2) We didn't send in any "additional relationship evidence" when applying for AOS.

You obligated the K1, now you just start the Aos process. Fill out the I-485,864, ead(If you want to work before GC arrives). No need to send evidence of relationship but you will want documents such as bank statements(joint), utilities bill or lease in both your names, health insurance card,pictures in case you get called in for interview. Find a honest Civil Surgeon that will xfer your immunization records instead of trying to fleece you out of money for unnecessary physicals, you might have to update your immunizations(check your private insurance they might cover them 100%,mine did.)

The AOS is not as hard as you think to do yourself, if I can do it so can you. I'm not paperwork savvy

Supporting evidence as the stuff you mentioned isn't asked for just yet. They're only asking for proof of being married within the 90 days of you arriving which makes you eligible for filing AOS. I'd personally save those pictures and joint things for the interview. Some people have problems even getting anything on paper before they receive EAD well besides SSN.

We filed my AOS papers about a months after the i-94 expired or so. I for some reason felt really limited in that time(I won't drive with an expired license/permit for example). That overstay won't cause an issues at your interview since you're adjusting your status based on your usc spouse in which case your overstay is forgiven.

Many K-1s don't even have an AoS interview.
