Your 10 year ban would start from when you left the US. Did you leave in 1999 or is that when you started being out of status? Good luck!

it looks like you love living in america so much as there is one over stay you tried 2 types of visas which sure will raise a flag for your k1 this is just my view think about it and plan you journey properly

please do not add fear to the OP with unfounded rhetoric, the K-1 would actually be the appropriate visa to come live here...

I will echo what others have said. You have served your ban, but be prepared to be questioned about the overstay and the subsequent visa petitions. Depending on what country you are coming from, the relationship evidence needs to be between excellent and rock solid. No matter what anyone tells you, this WILL be an issue. It won't by itself result in a denial but if anything else is out of order coupled with this it could very well lead to problems.

Some things you didn't touch on which will have an impact on the decision. Did you leave on your own or as part of an immigration proceedings. If the later, did you self deport or were you deported. These will all have an impact as well.

Stay strong and no matter what, but upfront and honest with the immigration's people and I think everything will work out for the best. Don't get discouraged by the roadblocks and delays that will pop up. In the end it will all be worth it.

Hi all,

So glad that I have found this website and meeting so many people with great advices here. Well, I have an issue as now that me and my USC fiance are applying for K-1 visa, I'm very worried about my overstaying issue way back in 1999. I had overstayed in US for about 2.5yrs, tried returning to the States 3 months later with a 10 year valid B1/B2 visa but was refused entry. In 2006, tried to apply for student visa but was rejected. Had given up hope to return to the US and never expect to meet my true love who is a USC. Really need advise and appreciate if anyone would be able to assist. Thank you!

wat would you do if you were the embassy/USCIS/CO? Would you approve when the rule states not to overstay?

You're current validation of an on going relationship must me real solid at this point. I think they will be hard on that issue due to prior over stay.

I left on my own accord in Oct 1999. When I tried returning early 2000, I was refused entry but nothing was being stamped on my passport. Thank you for your encouragement and we will stay strong. I regret doing that so much now because if my visa is denied both of us will be so heart broken. Its just not worth making silly mistakes like that. I never thought of the future, i was 22 years old then, all i thought of was fun and that i like the country, so I stayed on :(

Thanks, Malaysia Girl! May I know when did u get ready your cert.of good conduct? I read that it actually needs to take 1 to 2 months to get it. Should i apply now since our NOA2 will be due any time soon?

Oh YES, do apply for your Letter of Good Conduct! I did mine immediately after the receipt of my NOA1.

Ampun, late reply. I think the Letter of Good Conduct is valid for one year. :)
