SO I am pissed we got an RFE and not our NOA2, but it was a stupid mistake on our part and a quick fix. My fiance (the petitioner) did not sign his G-325A form. Now what I want to know is, should he send a new passport photo when he sends the form back off?

Also, I checked all our other forms, his last name is spelled correctly on all of them, included on the address label on the RFE, but the inside the letter they have put an extra "e" on the end of his name. Should I be concerned or is it just the person writing the letter not being able to type?

He's beating himself up right now, but I am just thankful it's a quick fix and not requests for even more evidence etc.

Not GOLD ADVICE. But they already have Passport Style Photos. Tell the Dummy to make a Copy of the 325 he did'nt sign and Sign it in Blue Ink and send the New 325 to address the RFE. Date It! That should do it. Of Course they won't Approve without a Signature.

Thank you he's sent it back off today, overnight recorded delivery, so *fingers crossed* we get NOA2 in the next couple of weeks!

@ farid$lisa we were sent an envelope with the address on there, send the evidence you need plus the first blue sheet in there and send it to the address on the RFE

The ink color you sign in doesn't matter, thats mostly an urban legend Somehow its believed that signing in some other color than black makes it more authentic as an original copy, which may have some validity prior to the invention of the color copier.

There is some state requirements for black ink on notary seals, but the intention was to make them "photographically reproducible" and only applies to the notary's identification info and not the signature.

i think this is true because i sent a scanned letter of intent and G-325A but the only rfe we got was for his passport.

To me ! WRONG

There is already a RFE. Now I see advice to SCAN the 325 and send it. IT requires a Original Signature. It don't matter to much if in Blue or Black Ink but the 325 Requires a Authentic Signature and Date. Just as the 129-F, the Letter of Intent.

Excuse me? and the point of your post was what exactly?

I think I'm allowed to be annoyed at ourselves that after waiting 5 months and what we get back is an RFE. And all we needed was one lousy signature, Which has knocked us back even further. I came on here to ask a valid question, if you don't have an answer, don't bother posting.

To the others who were ACTUALLY HAD SOMETHING USEFUL to contribute, we sent a fresh form with original signature, I don't know what color, but we did all the other paperwork with black ink and the only problem we had was a missing signature, so so long as you don't use a crayon, I think it's ok using either :P

Actually, you had every reason to be pissed at the nature of the RFE. The adjudicator at USCIS has the authority to approve the petition even without a signature on the G-325A and just forward the petition to the Embassy for signature at the time of the interview.

Sounds like you just had an adjudicator who had nothing better to do than issue a RFE when he wasn't REQUIRED to.

Sorry this happened, but your petition should be back in line quickly for approval after USCIS receives the signed copy.

Good luck in the rest of the process.

What good does it do, ... to be pissed?

AZ,... respectfully,... I'm wondering how you know such intricate workings of the adjudicators at uscis? that they have the authority to approve a petition without a signature?? Signatures in our culture are......PRETTY DAMNED IMPORTANT! as is the lack of signature.

Maybe the adjuticator's dad or mom died... i.e., they were having a really bad day. .... (an adjuticator with NOTHING BETTER TO DO???)

"but your petition should be BACK IN LINE" shortly???

Damn... just yesterday, someone else was proclaiming how when you get an RFE, .... YOU GO TO THE BACK OF THE LINE!

... maybe because I'm not a cyborg who is incapable of having feelings? This whole process is frustrating as we all well know, there was still no point to your post whatsoever, other than to poke and prod. I'm allowed to be annoyed, end of discussion. I've already said we've dealt with it, so I don't know why you're pushing the issue.

@ AZ- it's a form which isn't that important, I don't see the point in it tbh, but it did need to be signed, whether at this stage or at the embassy stage, I don't know what you said is true, who knows how those people work really, but either way, at least it's done now.
