Hi all,

My husband came into the US in August on the K-1 Visa and we were married in October. We filed for the AOS about a week after his I-94 expired but he never applied for his SSN. Now I'm hearing that he won't be able to apply for a SSN since his I-94 is expired. Does anyone know how long we have to wait now until we apply? My concern is that my company is changing insurance policies and he requires a SSN to be on my insurance. :( I don't want him to be uninsured for a whole year. Assistance appreciated!

December 2nd, 2011 - AOS Packet sent

December 8th, 2011 - Received electronic NOA1

January 3rd, 2012 - Received notification that case has been transferred to CSC

January 4th, 2012 - Biometrics

February 11th, 2012 - Employment Authorization Card received

February 25th, 2012 - Social Security Card received

August 24th, 2012 - Green Card Received

August, 2014 - I-751 sent

August 2014 (two weeks later) - NOA1 Received

March 2015 - RFE Received

May 2015 - RFE Packet Sent

July 28th - Letter received for interview

August 13th - Interview (GC Pending)

Do you have the EAD?

If so - you should be able to get the SSN for it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
