Deporting my wife

My wife received her green card last week (2-yr card). She has disappeared and cleaned out my checking and savings accounts. Is there any recourse that I can make to have her deported? Also she can into the country 2 years ago under a K3 Spousal Visa. We were not married until she arrived. Therefore, we should have applied for a K2 Fiance visa. Any suggestions how I can get her out of the country for good?????

Wow. Don't even know where to start.

There must be a full moon or something....

All you can do is report her to the USCIS... file a police report for the missing money (?) and start divorce proceedings.

(You meant K1 visa, just to keep your facts straight).

There will be others here who have direct experience with this...

So sorry.....

Jen

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

I'm sorry to hear of the problems. I think you mean she should have entered on a K1 fiancé visa were not legally married when the visa was issued. I'm not going to ask how you were able to do that, but I'd speak with an attorney right away.

That is awful.

I would follow diadromous mermaid's advice and speak with a good attorney straight away.

Sadly, it appears to have been a planned event.

Troll alert - its amazing how many "brand new members" with exactly the same (or reasonably similar) circumstances (or sob story, however you want to look at it) joined over the last three days. Its also interesting that apparently it's only women engaging in this "terrible behavior." Personally, I smell one angry, bitter rat...making up troll stories under several different names...why would this person post in "removal of conditions, anyway?"

Hmm, possible, but I don't think that one error that might be a typo (typing a 2 instead of a 1) means he absolutely must be a troll (although while I've heard of people entering under K1s despite being married, I'm not sure how or why one would enter on a K3, which requires a presumably forged marriage certificate, rather than on a K1, especially since two years ago K1s were much faster than K3s). And if I'd done this process without VJ and my husband left me, I might go looking for help on the Internet and find VJ for the first time and my first post might be about his leaving.

Just saying.

I'm guessing we'll find out more definitively as we see his further posts on the subject (or lack of posts).

I am a bit skeptical as well. I have been here since May and saw little to no activity such as this and now all of a sudden, wow, reading about it all the time. I am not one to question but also wonder why so many right now. Just seems a little strange to me but we all know this happens a little more than we would like to believe.

I'm sorry to hear of the problems. I think you mean she should have entered on a K1 fiancé visa were not legally married when the visa was issued. I'm not going to ask how you were able to do that, but I'd speak with an attorney right away.

Thanks Mermaid. Contacting a good immigration attorney is my next step. Already filed a police report - which is still making it through the local "system" in the police dept. I was hoping someone had been down this road before and could advise me of what I'm getting myself into. I've tried to contact the USCIS but the phone is always busy. Hopefully the attorney can help me get through this. Thanks Again.

Angry, hurt and bitter - yes I am - going through a roller coaster of emotions. Didn't know where else to post the message. When you trust & love someone unconditionally and they react this way, well it's difficult to understand and you can't help but ask yourself why? numerous times through the day and night.
