I-212 and I-601 where to begin

My boyfriend of 2 yrs was in jail for 2nd dui and possession of .9 grams of cocaine and 4.1 grams of thc. One of the drug charges was dropped, can't remember which one. ICE came to see him a week before his release date and told him he would be detained then deported. He asked for voluntary departure and was told he would get that if he signed said papers. There was no meeting with a judge. they deported him with a 10 yr ban in March 2008. We were married in 2009 and have a 2yr old daughter. I've talked to every lawyer in wisconsin and all said very slim to no chance he could return before 10 yr ban. From what i can tell he is eligible for an I-212 and I-601 I don't even know where to begin.

Timeline

Realistically, plan to live together in Mexico for the duration of the ban and then begin the spouse visa process.

You begin by collecting evidence that proves it's an extreme hardship on you for your husband to be separated from you, and that it's not possible for you to move to his country to be with him.

You have more to worry about than the ban and the waivers. The drug conviction makes him inadmissible to the US, and a conviction for anything other than simple possession of less than 30 grams of marijuana is not eligible for a hardship waiver. I don't think he'll be eligible for the I-601 waiver even after the ban has expired. Better find a very good immigration lawyer who specializes in waivers. Have you talked to Laurel Scott?
