Tourist Visa Denied (Was in USA 1 year back)

My mother-in-law was in USA for 11 months in 2010 (we took extension). We were planning for another visit and went for interview for tourist visa on Nov 19 2011. The visa was denied. I wanted to check how long should we wait to apply again? Since she was there in 2010 for almost a year, I think we should have waited for couple of years before applying. What do yo think?

Also, we did not mention her job last time... she has been working for state government for over 30 years... We missed that in our DS-160 application. Probably if we take all the proof and also fill that out in DS-160, will that help? She has no intent to stay in USA... it is just for a visit.

No one working for a state government gets a one year paid vacation....obviously she was working (likely providing child care) and now, after just returning, she 'needs' to 'visit' for another year? I imagine that on her first application she said she was going to stay just a few weeks....but then, suddenly, she decided to stay nearly a year....doing what? Watching TV? No wonder they denied her....this should be a lesson...do what you say, stay only as long as you announced, because if you don't, why would the consular officials believe a word you say the next time you apply for a visa?

And babysitting or child care is NOT allowed by B2 visa holders, no matter if the child they are caring for is a grandchild.

Vietnamese are always got problems when they extend stay from their tourist visas, because Vietnam is well-known with immigration from tourist visa. It is a red flag that she extended when she was in the US (I-94 was for 6 months I believe.) I guess you can try to do the sponsor application carefully later. Good luck.

Noah before you say something rubbish you should have asked me why she took the extension??? She stayed because her daughter my wife died after giving birth to my child.

You used the pronoun "we" in every sentence....'we just want her to visit', 'we asked for an extension' and no mention whatsoever about this supposed event. The tone and gist of your posting gave no indication of this happening, nor did you refer to it (nor did she apparently) during her latest interview; in fact, the only concern you mentioned was something about 'we didn't mention that she works for the state government;...etc......

so who is 'we?' And why weren't you outraged or concerned that the embassy didn't ask (or was informed) about the passing of your wife as the reason for the extension?

There is something missing from this story.

I think somebody is telling porky pies.

But lets say it was true and she died some point within the initial 6 months, then she still stayed an extra 5 months, a funeral would be a week or two.

I like that phrase....'porky pies'....kind gets to the heart of the OP's story.... Most people would have mentioned the passing of a dear loved one, especially a spouse, at the beginning of their posting...perhaps something like..."my MIL visited us a year ago, for the birth of our first child, but something terrible happened and my wife passed away during childbirth, so we needed my MIL to help out...."...but all we heard was some alleged concern that 'they' (the 'we') forgot to mention on the MIL's visa application that she supposedly works for the state government....

Guys I am sorry it is not porky pies like you are saying... I did not want to bring that up as I was getting really emotional... I hope you guys do not need a copy of death certificate to believe me at least now. You should at least give me a benefit of doubt... I emailed to my state's sentator and they said they will contact them for the next interview... I would like you guys to please edit what you guys have said as just do not know how disheartening it is to read such things... You guys will never understand the loss I am going through. I did not want to mention about her because it puts me in depression whenever I start thinking about the episode. I was in the hospital next to her when she was dieing... My mother-in-law had to stay here because I had no other close relative in USA who could have helped me in that dire need. She stayed here and took leave without pay for several months.

How old are you? Just put yourself in my shoes.... Young guy who struggled all his life and once things started going great, the happiest day in his life turned out to be the worst....

See this was one of the reason I did not mention about that unfortunate event... Because I did not want to have conversation about that again and again. I do not expect you to even understand what state of mind I am in... but please trust someone if he says he lost his young wife.

My daughter in with my MIL and my daughter is lucky that she has a motherly figure. I would like her to bring her here, stay here for few months and I can take her to few places as last time we couldn't do anything that we had planned to do after child's birth... She could help me in transition as my daughter is very close to her.. Thanks for taking time in reading.

What is the reason for MIL wanting a vistor visa now?

Now that some of the missing pieces have been brought to light, it now maks sense why the CO has denied the MIL visitor visa application.
