Entering without a K3 and no problem for AOS

Zig Ziglar would refer to this as "stinkin thinkin". Unless an actual lie to a direct question is placed in the record, a generic truthful answer will not result in a finding of misrepresentation. For instance, if the CBP officer specifically asked, "Are you married to a US Citizen?" and you LIE.....AND..... it gets noted in the record, there would be a problem. Otherwise, no worries. Really. Get over it.

Again, read post #10 and simply believe it, because it's true.

Very interesting concept. So if there is no risk using this method, why are so many people associated with VWP countries bothering with the Fiance Visa process? If they can simply fly to VWP country, get married and then have the spouse enter under tourist Visa and AOS?

I never said there was "no risk". However, once the foreigner is legally in the USA without a material misrepresentation being made, the "intent" at entry for a spouse of a US Citizen is no longer an issue. VWP is not equal to "tourist visa" but the concept is the same. VWP entrants give up their right to appeal an AOS decision. Tourist visa entrants do not.

Hello People,

I thought my topic was closed but i got some great reponse, thank you

to add more details, yes my gf and her now-husband got married in France (tahiti French Polynesia, to be exact) SHe is a french citizen, he is an American citizen and they have a child together who only has french nationality. couple month after their marriage, she enter the US with a tourist visa and now she is living the life next to her husband and she told me she just needs to fill up paper work to adjust her status and her daughter status.

as i am filling my AOS, i can see that she will have a lot of blank in her papers (Alien Number, Current status -ex : K1 Fiancee Visa, etc...,)

I am pretty sure that entering the US as a tourist and filling for a green card is pretty much impossible...don't you think ?

02-2007 : We Met and started Dating

03-2007 : Venancio & Heiani became offically Boyfriend&Girlfriend :P

12-2008 : Venancio's first Trip to Tahiti :)

05-2009 : Venancio' second trip to Tahiti :)

08-2009 : Heiani moved back to French Polynesia :(

17-04-2011 : Venancio proposed to Heiani....Fiancés Status :)

30-04-2011 : Heiani goes back to tahiti...more long distance :(

14-05-2011 : NOA1

18-07-2011 : NOA2 ..... APPROVED !!!!!!! :)

11-08-2011 : Packet left NVC for US Embassy Suva, Fiji

06-10-2011 : Interview Date : SUCCESS !!!!

23-10-2011 : POE : Honolulu Hawaii

09-11-2011 : Marriage : Mr & Mrs BERNABE <3

09-01-2012 : Application sent for AOS

Absolutely possible. She is here legally. She can adjust status. If HER daughter is also HIS daughter, the daughter can become a US Citizen.

If that was so there would not be much activity in the "Adjustment of Status from Work, Student, & Tourist Visas" section. Filling for a green card = Adjustment of status (AOS).

I myself came on the VWP in June(although I was not married at the time) said truthfully that I was visiting my boyfriend. No problem whatsoever. We married and planned to go back to my home country together to have another marriage ceremony & visit my family before my 90 days were up. At that point we realized that if we did that maybe I could not cross the border back to the US again on the VWP and we did not want to spend 6 to 9 months in Hungary to wait for a visa. We did some research. It turned out we can file for AOS. That's what we did in September.

We had our interview a week ago. We were approved, only waiting for the green card to arrive. I did not have an alien number, either. They just gave me one, it was on the first NOA. Current status: visitor on VWP.

Right. Most foreigners don't yet have an A number. You just enter none. If unknown, enter unknown. They'll assign one as a part of the process.
