Just wondering if there is a chance that I could have my petition expedited. I know pregnancy is not a reason to expedite, but financial loss is. Would they look at the fact that it is an extreme financial hardship to have to provide for our child on my own because my fiance is not here?

Concur with the above.

Also - the question to ask is - why would it be a hardship for money if your fiance is not there? He could wire you money for the child. (place yourself in USCIS shoes)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It'll be more expensive for him to come here (travel, wedding, pay for AOS, wait several months until he can work), so no, that would not be a factor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My fiance is from Cameroon but living in Korea on a student visa, which is where we met. Because he is on a student visa, he is restricted to working 20 hours per week, from which he has to pay his living expenses. It will be very difficult for him to send me money. It is not that he doesn't want to - he has already said he will figure out a way to send me money, but I don't see how that will happen. If he sends me money, I will be worried that he is not taking care of his own needs and saving up for his plane tickets here.

The biggest financial hardship I am going to have is childcare. Rates for childcare equal about half of my income. That leaves me very little for rent and other monthly expenses. I am looking at having to apply for childcare assistance from the state because I just can't afford childcare on my own. If my fiance were here, he could stay home with the baby, eliminating the need for childcare. Also, the sooner he is granted permission to come to the US, the sooner he will be able to file for permission to work. My fiance has a high level of education and has much higher earning potential than I do. With 2 salaries, we could easily afford childcare and monthly expenses.

I know we have to follow all the legal steps to get him here, which is exactly what we are doing. I just think it would be logical to allow him to come sooner given our situation. I prefer not to have to rely on assistance to raise my son when he has a father who wants to be here to work and help support his family. I'm just very frustrated and sad right now.

It doesn't hurt to call and make the request. They can only say no. However, when you call, make sure your reason for expedite is narrowed down to 3 or 4 sentences. They will ask you which category pertains to your request. You will choose extreme financial hardship.

My expedite was approved and I would bet if I asked everyone here if it was possible they would have given me the same answer as you got. I had different reasons than you, but still it is worth a try for you. I received my approval for expedite 2 days after my request.

Good luck on expediting the case, however, I would be shocked if they granted it.

I cannot wait to have children with my fiance, but, because I it would be a financial hardship as well as emotionally hard to not have him around while pregnant, we took precautions to make sure it didn't happen; we also spoke about what would happen if I were to "accidently" get pregnant i.e. financial support, more visits, etc. I'm sure there are many other women in my shoes. So, if they were to expedite your case, they would have to then expedite all cases like this - which I don't think they would do.

Just a thought to consider :)

I agree with CMoore25, getting and being pregnant is both a choice and avoidable (in most cases), so effectively if USCIS expedited on these grounds then it would be doing so because you CHOOSE for them to. When it's put That way it illustrates how unlikely that scenario would be! I really hope you manage to find some way around this. Also, they might consider it presumptive on the part of the beneficiary...what happens to the relationship and the child if the visa is not granted?
