Hi,

Me (UK) and my Wife (US Citizen) are filing our I-130 and we have a few questions. Q.14 On the form asks for the "Arrival/Departure Record (I-94)".

I don't remember getting one and im pretty vigilant about keeping hold of documents. My POE was Dallas. I have done some research and read that if you arrived using an ESTA (like i did) then you dont get issued a I-94. Is this correct?

On the ESTA website under "Help" this is written;

"If a Visa Waiver Program traveler has received a travel authorization approval through ESTA, does he or she need to fill out an I-94W?

The implementation of the ESTA program allowed DHS to eliminate the requirement that Visa Waiver Program travelers complete an I-94W prior to being admitted to the United States. CBP has transitioned to paperless processing for Visa Waiver Program travelers arriving by air or sea who have obtained a travel authorization. Most carriers are now capable of receiving and validating messages pertaining to the traveler’s ESTA status as part of the traveler’s boarding status. Travelers entering the United States under the Visa Waiver Program who have an approved travel authorization will no longer be given a green I-94W departure coupon in their passport"

This makes me sure i was never given one and suggests that they no longer do which is ok but for the purposes of my I-130 and I-485 application what should i put in the sections asking for I-94 information?

No you do not get a I 94 with a vista waiver

When you come in on a K1 or a K3 you will

Filing those two forms together ain't a K-3 visa, at all.

Filing those two forms together ain't a K-3 visa, at all.

The I-130 asks if the beneficiary is currently in the USA. If visiting the USA, you answer including the I-94 number, if any. This would be true in CR1, K3 or Adjustment of Status.

Facts are cheap...knowing how to use them is precious...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
