I'm in general pretty confused about the affidavit of support papers. I currently "qualify" with my income, but my last three tax returns are well below the poverty guidelines because I was a student. I am choosing to have my parents be co-sponsors. Here are my questions.

1. If both my parents are cosigning since they filed taxes together, what forms to each of them need to fill out? I was thinking I fill out I-864, my mom fills out I-864 and my dad 1-864A. Does that sound right?

2. I am signed up to file electronically. Obviously all the millions of documents we have to submit are going to make a pretty huge file. I'm afraid it won't go through in e-mail. Does anyone know if I can send my documents in a PDF then send my parents in separate PDFs as long as I attach some kind of cover letter explaining that they are coming separate?

3. I have tax transcripts. Do I still need to include my W-2's? Or is that just if I only have photo copies of my tax returns.

4. After I have all my papers together, I e-mail them to the consular for electronic filing at the national visa center. Do I need to send them to my husband before his interview? Or can I just bring him the documents when I go down for his interview?

1. You are right - you file I-864, and if your Mom files I-864, your Dad files I-864A.

2. I hope someone with practical experience will guide you on this.

3. If you are using Tax Transcripts for yourself, there is no need of copies of tax returns or W-2s. For your parents, since both are co-sponsoring, Tax Transcripts are fine (W-2s are required if only one of them is sponsoring)

4. Maintain copies of everything you submit and send those to your husband or you can take them if you are going for his interview.

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

If you currently meet the income level - you do not need co-sponsors - even though your last 3 years are below the level needed.

They look at current and future earnings - they use past returns to see a trend.

So if you have a strong job, and letter from the boss saying your going to be around for a while, you should have no issues with your past income - they can see you were a student, and judge accordingly.

If they want more sponsorship - then use your parents, but I would recommend to use your own income for sponsorship first.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A gree to an extent. A lot depends on the Consulate or Embassy one is going to. Some COs insist on co-sponsor even when the current income is sufficient in some case - for example if the Petitioner was a student and didn't have income before or if the current income is just a little bit more than the 125%. Hence I advise you to go for the co-sponsor.

I didn't use a co-sponsor but I am taking a co-sponsor set to interview for wife, as I was a student till May, eventhough my current income is very good.

Once the PDF files are created, you can find somebody with a full version of Adobe and use the "Document" pull down menu and select "reduce file size" to get the file size down. Only attach one PDF to an email. Joining multiple PDF files also requires the full version of Adobe. If you don't know somebody who can help you with this, Kinko's (FedEx Office) staff can do it for you.

Facts are cheap...knowing how to use them is precious...
