I KEEP HAVING SMALL ISSUES ARISE WHILE TRYING TO FILE MY AFFIDAVIT OF SUPPORT! ALL THIS TIME NO REAL QUESTIONS...ALL THE WORK MYSELF AND NOW THAT WE ARE SOOOO CLOSE!!!! NOW I HAVE ISSUES! OK NOW THAT I AM DONE RANTING..... I AM SEEING THAT I NOT ONLY HAVE TO SEND ALONG TAX TRANSCRIPTS BUT THE W2'S THAT GO WITH THEM? CAN I JUST SEND THE TRANSCRIPTS, WHAT IS THE NEED FOR THE W2'S ANYWAY? ALL THE INFO IS ON THE TRANSCRIPT? I DONT HAVE MY W2S...NEVER KNEW I WOULD NEED TO KEEP THEM? IF I DO NEED THEM HOW DO I GO ABOUT GETTING THEM BACK?

Wait--this is too complex. If you send the transcripts, that is ALL YOU NEED. But if you for some reason I can't understand you send the actual tax returns, then you do need the W-2's....so make it really really simple...transcripts ONLY !!!

That is exactly how I felt about it! However,better safe then sory when it comes to this entire process. I am very happy to see you replied to my post. I have read many of your replies to other members and you are always very clear and to the point! if you don't mind though now that I have you attention :) maybe you can also help me with this?......

My current yearly income is above poverty level, but in 2008, 2009 and 2010 I was below. Due to my last 3 years income being below poverty level, will I need to have a co-sponsor to meet the income requirements even though in the current year of 2011 I meet the requirements? Also I have been at my job less than a year?

I guess the reason the poster is confused is because a lot of people here are suggesting that W2's should be submitted together with tax transcripts. I did see those posts myself AFTER submitting my application for ROC and yep, it got me a bit worried. I didn't have our W2's. I only submitted tax transcripts. I hope I don't get RFE'd because of this.

First of all, transcripts are the preferred documentation--says exactly that right in the I-864 instructions...amazing how many people think they know better, but I have to tell you--when all else fails, follow the directions--REALLY !!! Transcripts are ALL you need--period.

Now as to current income, if it is marginally above the minimum, then they may require a joint sponsor even if you are over the limit, and if all three prior years are below the minimum level, it increases the odds, but there is honestly no way to know until you get input from either NVC or at the interview. If you are barely over, better start thinking about a joint sponsor just in case. As far as being at the job less than a year, a strong letter from your employer will be a big help.

LOL OH HOW APPROPRIATE "FOLLOW THE DIRECTIONS"! YES YOU ARE RIGHT. SOMETIMES ME DOING SO MUCH RESEARCH IS WHAT GETS ME CONFUSED BUT IT IS MY DETERMINATION AND RESEARCH THAT HAS HELPED ME AVOID A LOT OF HANG UPS ALL AT THE SAME TIME. SO I WILL MOST DEFINATELY INCLUDE MY TRANSCRIPTS, AS WELL AS A STRONG LETTER FROM MY EMPLOYER. SHE HAS KNOWN ME FOR MORE THAN 15 YEARS AND I AM ONLY 27 :)I WAS NOT WANTING TO BUT I JUST HAVE A STRONG FEELING I SHOULD GET A CO SPONSOR. BETTER TO HAVE ONE NOW THEN HAVE TO GET ONE LATER AND CAUSE DELAYS. AS FAR AS SPONSORS I HAVE TWO IN MIND. ONE IS MY SISTER BUT HER INCOME IS BASED OFF OF DISABILITY (2,000/MONTH)AND FINANCIAL AID FROM SCHOOL? WOULD THAT BE OK SINCE IT IS GOVERNMENT FUNDS? THE SECOND IS MY DAD HE IS A CARPENTER THROUGH THE UNION AND MAKES GREAT MONEY BUT IS LAID OFF FROM TIME TO TIME AND DRAWS UNEMPLOYEMENT OCCASIONALLY...AGAIN GOVERNMENT FUNDS? WOULD EITHIER OF THEM BE AN OPTION FOR ME?

My husband works for his company for 15 years already. Do we need to include Letter from Employer along with 3-year tax transcripts? Or we just need to include latest pay stubs? Thanks a lot

Include the letter if you want (I opted to do so), however, such a letter is not a requirement.

If his income is well above the minimum, then a letter is not going to change things, but if it is marginally above, then a letter showing he has been employed by the same company for 15 years could be a big help proving that his income will be there in the future.

Also, you don't need six pay stubs--all you need is one that shows year to date income so long as it is at least six months. Here are the exact words from the I-864 instructions:

You may also provide pay stub(s) showing your income for the previous six months.

As you can see there is nothing about six pay stubs--just about income for six months, so one pay stub usually takes care of that since almost every employer includes year to date income on each stub.

Thanks so much for your cant be clearer answer Magical :) His income is much higher than the poverty line. So we are not gonna submit letter from employer, and we just submit 1 pay stub and 3 years tax transcripts. Again, thanks so much.
