Ok, I'm very new to all this and am trying to get a K1 for my fiancee without the use of a lawyer. Generally it seems straightforward, however I'm getting hung up on the Affadavit of Support. The flow diagrams here don't seem to mention it, and the USCIS Website doesn't provide much explanation. I imagine my answers are embedded somewhere in this website, but am struggling to find a clear answer...so here I am!

Questions:

1. Although the USCIS site for I-129f's doesnt' say it, I believe a K1 must be accompanied by an Affadavit of Support. So my question is: Do I send the Affadavit of Support *with* my K1 application, or does it get sent later in the process?

2. The USCIS site references 2 forms for Affadavit of Support(s): the I-864 and the I-134. Which to use? The I-864 is a little less stringent, for example the I-134 requires a letter from my bank and my employer. Doable, but a pain. I-864 just seems to want copies of everything.

While I'm at it, another unrelated question:

3. Someone mentioned that besides our Letters of Intent to Marry, I should include a longer letter expressing my love as well as a history of our relationship. That would be to supplement all my other evidence (Plane receipts, photos, etc). Is this a good idea? I'm taking a lawyer's approach, i.e. provide what's asked for and nothing more. Sometimes the extra stuff will work against you.

1. You will provide your fiance/fiancee with the I-134 later on. Depending on your embassy, your fiance/fiancee will either 1. take it to his/her interview or 2. post it in with his/her packet 3. No need to provide at this time with the initial I-129F.

2. Most embassies require the I-134... I can't seem to see a country in your profile. You will need to provide the same evidence regardless of the form (letter from your employer and/or recent paystubs - both if you can and tax transcripts.) Basically, it's used to show that you can support your other half upon arrival. In terms of 'legalize', you will definitely file the I-864 for your AOS once you and your other half are married. That will be a binding legal document.

3. I've never heard of this. You will provide the letter of intent, as you mentioned, and evidence of meeting... but there's no requirement for that letter, to my knowledge.

Hi there,

1. You do not have to include the Affidavit of Support with the I-129F. Your fiance will need that to take to the interview.

2. The I-134 is what you fill out for the K-1. Make sure you get specifics on what paperwork your embassy requires that be included. (how many years tax returns, w2's, bank statements, etc)

3. In my I-129f packet, I included a one page letter in place of answering question 18, entitled I-129F Supplement: Part B, Question 18. In this letter I explained the circumstances under which we met and the progression of our relationship - nothing too detailed but enough to establish the basis and strength of our feelings for each other.

Read the Guides and follow them, the Example Forms and read the stickies. Then ask your questions.

Support affidavit is for the interview not the 129f filing.

134 is used for the K-1, 864 is used at AOS.

Most folks do not add the long letter and some do. The answer can be Embassy specific so you also need to read up on the Embassy specific requirements for your country.

For question one, No you do not send I-134 with your I-129f package.

Yes you will need I-134 for the interview and I-864 once your fiance is in the united states, so yes you will need to file both in the near future.

and when i file my application i did send pictures and copies of planes tickets and all that good stuff.

2. What is the difference between an I-864 and an I-134? MOST CONSULATES USE THE I-134. THERE ARE A RARE FEW THAT USE THE I-864 FOR K1. YOU NEED TO COMPLETE YOUR PROFILE SO WE CAN TELL WHICH EMBASSY YOU'LL BE DEALING WITH. :-)

I agree with most of the answers and there are always more than one way to do things. I purchased a step by step guide which was AWESOME it left nothing to chance. Giving lots of evidence on your relationship... a very smart thing to do. I was also prompted to make sure there were family photos taken with you and your fiance(e). they said these are like gold. I was instructed to send everything with the K-1 as the information will be requested anyways. If only I had known about the final divorce order needing to be a certificate we would already have our NOA2. The Consulate will want all the info on the I-134 so best to be prepared. The other will be needed but not until you get married. I say concentrate on the task at hand and good luck in the journey.
