Most likely, you'll send the Affidavit of Support to NVC in January or February, so the latest return will be 2010 unless you've filed 2011. However, expect the Consular officer to want to see the 2011 tax return at the interview regardless. A December petition approval is quite likely to have an April interview. If you are a long term "employee" with a good income, it's less likely they'll insist on seeing a 2011 tax return before April but if self employed, be prepared to show a 2011 tax return at interview.

We get a lot of these questions from people who confuse employee income from a tax return with "current income". It's only the self employed that use a tax return to show current income. Employed people pay stubs and/or employer letters as evidence of current income.

If you lose or quit a job in February, 2011, even your 2011 income is not your current income in March or April or even the day after you leave your job.

The previous year's returns are mandatory. The previous two years (IE: 2008, 2009) are optional, but can be helpful in proving an increase in income if you're close to the poverty level.
