hi,

i submitted the I-130 for my husband back in August. It has not been approved yet, but i just realized the person who filled it out for me made a huge mistake and now i need to revise my I-130. is there any way of doing this before it's approved? or should i wait til after? or do i have to pull it out and resubmit the I-130 all over again?? please help me out!!!!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

the question that asks if the beneficinary has ever been to the U.S.? a put no, but, although my husband is not currently here, he has been here before and since i paid an "immigration expert" to fill out the paperwork and trusted that he did everything right, i submitted the I-130 and now i'm freaking out because i realize that this is a lie and i don't want our case to be denied. the "expert" told me it would be better to say he had not been here since it was an illegal entry but i'm freaking out now and i want to rectify my mistake...

Yeah that's tricky. On this site no one will ever encourage you to do anything illegal (including myself), but at this point you have few options. If you had said / or decide to say that he had been in the US and they determined that it was an illegal entry, than technically the 'expert' is correct more or less b/c you would be automatically denied (though in that case you would be able to file a waiver - which I don't really know what all that entails). If you lie and they find out somehow that he has been in the US illegaly, then that opens up a real can of worms and it makes the situation that much worse and you may not be able to file a waiver and just might as well get ready to get comfortable in Mexico. I guess it's just a roll of the dice if you decide to keep things as they are.

Timeline:

02/04/2004 - A young Zinker arrives in Mexico to study Spanish and the dating game begins

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!

thanks for your response...from what i've gathered it really is just a game of luck at this point. i've talk to my husband about it and he's pretty much as confused as I am. i know that ive we get caught in a lie its pretty much over and like you said if we do say he's been here at least he can apply for a waiver...idk i'm just really confused at this point. i wish i would've found this site before i submitted my paperwork... :(

I've seen comments on VJ about consular officers reading the site or knowing people's usernames and such. Don't you think it would be a good idea to remove all the highly specific info, dates, photos, and names on your profile since you've opened this can of worms in a public forum? Hope it isn't a ToS violation to say that.

At any rate, this is a situation where a qualified immigration attorney would not be a terrible idea. It isn't just a matter of sliding by on luck for the CR-1, but this is something that could always come back to affect your husband's status in the future too.
