Passport name change

Wondering if anyone who has recently gotten married can shed some light on this subject...

I am the USC and just got married to my husband last month. I'm going through the process of changing my name and according to the DOS web site, I will need to send them my current passport to have my name changed: http://travel.state.gov/passport/correcting/ChangeName/ChangeName_851.html

Are they going to keep my original passport?! Or will they send it back to me?

The reason I ask is that I have a valid UK work visa in there that hasn't expired. (Note: We're not planning to go back to the UK, but still...) I wouldn't want them to 'take' this, if you see what I mean?

you are only allowed ONE passport...

you turn it in.. they will send you NEW ONE with name change..

i may not be a smart man.. but that seems logical reason..

it also says. you turn it in AFTER your Name has been legally changed...

Correct... but what are they going to do with my valid UK visa? I can't apply for that all over again...

You really have two questions. One is what does DOS do with your old passport. That I don't know, but in the UK they clip the corner off the passport and send it back to you. Generally one would assume that a reasonable country would return the passport for this very reason, but who knows if the US is reasonable ;)

The other question regards the validity of the visa, which would be an UK issue. Read this: http://www.ukba.homeoffice.gov.uk/visas-immigration/while-in-uk/transfer-visa-to-passport/ Some countries require the visa to be in your current name to be valid, but it sounds like maybe this isn't the case for the UK, although they don't explicitly say so.

Your old passport will be invalidated. That usually happens by cutting off the lower corner. The visa in this passport is still valid, which means that oftentimes tourists with an unexpired B2 in their old passport have to carry the old one and the new one with them.
