First off I'm sorry if this has been answered before as searching for the terms together yielded conflicting answers sometimes!

Simply put, My fiancee arrived in the US in mid July. We had to get married before October 11th. We got a social security number later August because even waiting 14 days he record was not on file! Then we got the marriage certificate on September 13th. We officially were married on September 24th and officially returned the marriage license to probate court today September 27th. I have also been told by ssa we need a certified copy to change her name on her ss card. However considering it will take yet another few weeks to be able to receive a certified copy I was wondering what someone here would do in my situation!

File the AOS with a copy of the license in her current name and just send a certified copy if an RFE comes in?

A marriage license and certificate are not the same thing. One you need to get married (license) and the other proves you are married (certificate). You need the offical certificate to do any name changes and for AOS. You just need to wait.

As I understand it, you have to get married within 90 days of arrival, but you do not have to file AOS within that period. You have time to wait for the documentation you need. I realize that waiting to file will push back your approval dates for AP/EAD, but I wouldn't think it would be any longer than if you filed now and got an RFE for the missing documents. I would wait.

You need your certified marriage certificate to file AOS. You can file AOS in her married name once you have that document. You do not need to show name change on SS card or any other "proof" of name change.

Go to the court and ask for a certfied copy - don't wait until they mail it to you. Ladies here in Butler County court were so nice that they wrote down my cell and called me once they received signed marriage license from the pastor. 30 mins later I picked up an envelope with 3 certified copies...

Thanks for the replies everyone! I was just concerned because of this October 11th deadline, but it seems since I have gotten married in the 90 day period it should be ok if I had to wait for a document.

However as one of you pointed out I may not need to wait. I will go back to probate court very soon and try and get a certified copy instead of waiting for one in the mail. Thanks again for the replies and the well wishes!

PS.

Sorry for the weird subject line. I have gotten the K1 visa already! :P
