I think the ex can be used here for some leverage but in a way less harmful to the children - Instead of asking him to co-sponsor ask him for help with getting you into a position where you can work and earn a living. This is a win for him because most likely his payments to you are partially based on your income. If he helps by watching or paying extra for someone or help you watch the kids you can work and earn enough to not need a co-sponsor. When you bring your guy over that job can go to him and relieve your ex of the extra money/time while you and your (then) husband work out whatever you can.. If your ex can look at the long term benefit of doing this it can be a win for everyone.

Oh, I agree completely with you. I have asked the ex to maybe help cover the daycare expense for one of our 2 kids, and that would have helped me to pay and afford the daycare. He told me no he couldn't. He works and has obligations in the evenings and he lives about 40 minutes away, so him babysitting is a big No for him. But I think this would solve everything. Pray that God would work this out and a co-sponsor will show up.

OH, I WILL. I AM ACTUALLY SO EXCITED NOW AFTER READING THE PREVIOUS POSTERS SUGGESTION ABOUT ASKING THE EX. I know how much the ex wants his money back, and he might

just do that. I will keep you posted on how it goes.

WoooooHooooooo.

Haha! That is exactly was what I thought might happen. I often hear men complaining about alimony and child support, so he may like this offer.

I have been reading here and sadly I can not see an instant solution. Heck I'd sponsor you myself if I could afford to! In your case it is obvious how much better off you would be with him here. Too bad there is not an option which requires him to go back to Canada if he ever applies for aid and you can go that route. The only other thing I can think of is if he can come to the US on a work visa and apply for residency and citizenship as the time allows, or is there another visa option.

My parents and their two kids came from Canada to the US, that is how I got here. They were unemployed and I was told it was months before we even had furniture. But this was 1965. Amazing how immigrants back then were willing to do anything to reach for the dream, yet today this 125% stuff today just assumes immigrants are here for freebies.

I've been reading today about the work visa. Maybe I am not understanding it correctly doesn't he have to have a employer here hire him first then they submit a work visa? Trying to find more info on it.

I don't think that asking the ex is that bad of an idea. I am not sure that it would look all that fishy, simply because he agrees to sign for him and he doesn't have to pay me alimony anymore. Nothing there to be sneaky about, it's just a fact. But he would be my last option.

I think that the 125% thing is just crazy. He's from canada and as he keeps joking, why would he come here to collect welfare when he has it better in canada. We just want to be together. November it will be two years that we have been together and traveling back and forth. But we will keep pressing on.

Maybe the work visa might work, but I have to understand more about it.

Thanks for your help.

Yes, for the work visa an employer here would have to sponsor him, it is not cheap. But he can contract for x number of years to pay them back in time.

He had been applying for jobs in his field of expertise and nothing was turning up. We were wondering if it was because when it asks if he is a u.s. citizen and is he permitted

legally to work in the u.s., he has had to say no.

So this is where I find it hard to understand how one can find a job here in the u.s. if they aren't legally allowed yet. And our atty told him not to do that. With all the bad advice the atty has given us,

this was probably bad advice as well.

He can say he needs sponsorship as part of his employment package. An employer may pay you $40,000 a year but give you $35,000 for the first few years to recoup their investment in your immigration. It is much easier to just hire one of the many unemployed Americans. Or maybe there is a Canadian company with offices in the US and he can work here that way. He can even offer to take less money for going to the US.

Don't forget TN visas for Canadians to work in the USA. They don't need sponsors just the job offer. You request the TN on entry to USA.

Is the Ex paying alimony or CHILD SUPPORT? There is a big difference.

If it's CHILD SUPPORT then you have no business negotiating it away especially when your children are so young. That isn't your money to do with as you please, it's money for your children meant to provide directly for their care & well being. If you need more money from your ex to cover daycare expenses then you need to return to family court and demonstrate to a Judge that the financial situation has changed (i.e. child Care support lost) so your ex should be ordered to help cover the new expense.

There are reasons CHILD SUPPORT can't be used as income for the Affidavit of Support, namely because technically & legally it's the kids' income not yours and you can't use income from a minor for the AOS.
