right now we are in NVC stage. our case gone be close soon some time.

hope we get interview date sometime in NOV but our 2nd marriage anniversary in Dec.

but my husband have his Law Test in 11th Jan 2012. he really want take his test don't want miss it.

if his entry in usa after Dec 2011 there is any kinda problem. i think before Dec he gone get CR1 visa & get 2 year's green card..if he come up after Dec he gone have his IR1 visa & get 10 year's green card i am right.

i am confuse about Citizenship. if he get IR1 visa does he have to wait 5 year's or he can take citizenship after 3 years.

If he arrives at the POE after your 2nd anniversary, he would point out to CBP that he is now entitled to IR-1 status.

Spouses of USC's If you're a USC, then I believe he has to hold his greencard 3 years prior to the N-400

if you have a two year permanent resident card,and then a one year extension letter,if approval on your remove of conditions then you will receive a ten year card,if your married then you can file for citizenship, three years minis 90 days, if your not married then it's five years.to file for citizenship,

If the marriage is more than 2 years old, you will be in IR1 (you don't have to go through CR1 processing 90 days before point of entry date )( before 24 months after 21 months)

Your case, if you got interview before 2nd anniversary, your are in CR1, you can ask CO to change it, CO can change it OR he can ask at POE to change to IR1... (at the first interaction with the CBP officer NOT at the document collection point)

(All the immigrants goes to a second officer for document collection after the first interaction)

If you got interview after 2nd anniversary, then sure, tell CO to change it to IR1... I don't think you are going to have an issue (I hope)

All the immigrants that come in US on marriage base, they can apply for citizenship after 3 years, they don't have to wait for 5 years like other classes of immigrants.

The visa will be given with a validity of 6 months. So that shouldn't be an issue, as you may get a December/ January interview, as your case is yet to be closed at NVC. If your husband enters after 2 nd anniversary, he can enter through IR1, which provides unconditional green card (yes 10 years) and it is good to enter after the 2nd anniversary in your case even if you get late November interview.

Citizenship requirement is 5 years of stay in US as permanent resident and not 3 years.

Navyk, if you follow my link Naturalization for US spouses to the requirements of a US spouse then it's 3 years if married to the petitioner continuously for the three years. Also some embassies tie the visa longevity to the medical date so it's not automatic to get 6 months on the visa.

Thanks Calibob for the clarification on the 3 years period for US spouse ( I had to wait for 5 years when I came as a dependent child).

Jazz88 please note this change regarding the waiting period for US Citizen spouse to become US Citizen. As far as the visa is concerned it will be valid for 6 months for us (Indians).
