Could someone explain the J-1 HRR in detail?

My fiance and I were preparing to apply for the K-1 but I just found out that he still has a 2 year home residence requirement from the time he entered the U.S. on a J-1 visa.

Now my question is, does he have to live in his home country, in his case India, for those full two years? Because he was working in Thailand for about a year.

He last exited the U.S. in November 2009 in which his requirement would be finished in November of this year unless the time he was working in Thailand does not count towards that HRR.

I'm very confused about this, can someone clarify this for me?

We haven't started the K-1 yet, can I start the petition now? Because it will take 8-9 months to issue that visa anyways in which his residency requirement will be fulfilled....

Yes you can submit the petition now. The home residency requirement does not prevent a petition from being filed.

Yes you can submit the petition now. The home residency requirement does not prevent a petition from being filed.

Thank you so much! This makes us feel a little bit better. To be on the safe side though, I think we will still apply for a waiver.
