We had our interview today and got Blue Slipped due to the I864 problem. Originally I (unemployed petitioner) sent the I864 and my mother (joint sponsor and also a household member) sent the I864. The CO's comments were that he couldn't say what exactly was wrong (and quoted some law) but that I, the petitioner, needed to fill out a new I864 form to include my mother, form I864A. He then said my mother's form was correct.

We've been looking at the forms and I'm now even more confused. What do I now put for question 21G? One for me, one for my husband and now one for my mother? What about my father? He's in the household. He's not filling out any forms but he was counted on my mothers original I864 form. Now he doesn't count anywhere? Or does he now need to fill out an I864A form? Is this going to be another problem? Should I have my mother complete the I864A form and just resend her tax returns and W-2s?

Any help would be appreciated as I thought I had this understood and now am really upset.

I'm so sorry this happened to you guys...I am not sure why the CO did that because i think you did everything right...is there anything else he said? did he tell you exactly what forms needs to be filled out?

Wow i guess it was a blue slip kind of day my husband got a blue slip today to at his interview because of a joint sponsor issue.. good luck im trying to figure mine out to at the moment.

No, he said he "couldn't" tell us what was wrong, just that he was doing us a favor because if the guys at the POE opened the envelope and discovered the "erroe" they could deny him entrance. Just pissed. Of course the Embassy needs originals so I'm trying to make the mail deadline but it's still going to be another week of waiting, assuming we do it correct this time.

Wow That's crazy!!! Ok My only suggestion is to go back and "look" at everything again look at the i864 and i864A look at which one you're suppose to fill out and which one your mother is suppose to fill out because if the CO can not tell you what you did wrong maybe he doesn't know if you did something wrong to start with and is just guessing you guys's papers aren't straight.

Your mother filing I-864 is correct, as agreed by the CO. Now you need to clrify in your thread the following before anyone can guide you.

  • Does your mother and father file jointly!
  • Are there any children dependent on them! and used by them as dependents!
  • Does your mothers wages or income is suffient to support your foreign spouse! or does your father's income also is required!
  • Did you submit the IRS Tax Transcripts or copies of the full tax returns!
  • Did your father file I-864A!

Your mother filing I-864 is correct, as agreed by the CO. Now you need to clrify in your thread the following before anyone can guide you.

1.Does your mother and father file jointly! YES

2.Are there any children dependent on them! NO and used by them as dependents! NO

3.Does your mothers wages or income is suffient to support your foreign spouse! YES or does your father's income also is required!NO

4.Did you submit the IRS Tax Transcripts or copies of the full tax returns My mother submitted transcripts for prior years but the full return for 2010 as there were no transcripts available in April when we first got them.

5.Did your father file I-864A! NO

2009 and 2008 are optional but those are the transcripts (can't know your mothers AGI without 2009 & 2008 W-2s) and you submitted 1010 full tax return (which has your mother's 2010 W-2s).

In your mothers I-864 in item 25 which amounts were filled in - meaning were those the AGI (Adjusted Gross Income) of both or just your mother - only your mothers income from W-2s should have been filled.

In your mother's I-864 in Item 21G, you should have just 3 (a. your spouse, b. your mother & c. father)

Also can you copy the actual objection raised by CO from the Blue slip, so that we know what exactly was his objection!

I had the same problem... And I called and ask for specific instructions.... I the sponsor filled out the I864A. And my co sponsor did the I864..... You are always the responsible party regardless of having a co sponsor.... I got this directly from the NVC... Hope this helps!

Also to make it easy for you and everyone... Just get the IRS number online and call and request a transcript for taxes... It's automated and fast... Make sure you have the persons SS #... You can order any years you want... It's free and the NVC accept these...

i got a blue slip too because of a missing i864A....did they tell you how long it might take after you submit the documents? i believe they put you on administrative processing?

My husband was told by the CO that if he turns in the "correct" forms (now I'm worried again) that he will get his visa the same day. But I don't think all Embassys let you get the visa the same day, some have a courier service that you have to pay for.

What country are you dealing with, I know some have mandatory AP.

What??? You are the petitioner and yet you filled out the I864A form? Not the I864 form? If that's true, that sucks because I just mailed the forms yesterday and maybe they are still wrong.

My mother is the sponsor and she filed the i864...i filled out the i864A and so did my dad because he files his joint tax return with my mother. THey specifically asked for his i864A...they didn't ask for my i864 because they said that my mothers i864 met their financial requirement. They told my wife that it CAN take 4-6 months but that's a bit hard to believe for me...i've been researching this out since yesterday and everyone seems to have gotten a response from them after the administrative processing within a month. Im hoping my situation gets resolved in 2-3 weeks...i really hope because its been so long...more than a year

Im dealing with the consulate in Pakistan. They took my wife's passport though because they said my wife can pick it up after they stamp the visa on it after she submits the remaining documents. I hope you're right re the same day visa after documents are submitted....
