Ou.r history is that my Ecuadorian wife first came to visit on a tourist visa in 2009? After first being denied witmh the help of an ex ambassador and a congressman she obtained the visa and visited many times. In 2010 she purchased a restaurant and was granted a change of status to a E2 but cannot leave the USA. In 2011 we were married and she is currently obtaining her green card for her and her 17 year old child.

The problem is her older son who is 23 wants to visit us and has twice been denied a tourist visa. The first time the Quito embassy told him that his mother was an illegal immigrant as their records had not been updated for her change in status to E2. We fixed that, he returned to the embassy with a beautiful package of materials showing that he is a university student in Quito, has all his expenses paid by me, lives with his grand parents, all his extended family have tourist visas and have visited the usa many times etc. In addition I, my immigration lawyer and a US congressman all wrote letters of support to the embassy. Result was three minute interview, did not and refused to look at any documents and denied the visa.

I am at a loss at what to do. Has anyone had any success at setting up a meeting with a consulate official to present the evidence supporting the ties to The home country?

From what you've stated, he has much stronger ties (mother and sibling) to the US than to home (school enrollment). That is what he has to overcome.

He has more stronger ties to US, he would come here and start living with her mom and apply for AOS.

They dont look if your extended family has tourist visa or not they look at each individual case. They know her mom came on B2 and then applied for E2 they are sure the kids would do similar things once they gain entry to US on B1/2.

Might work if she had an E2 Visa rather than status.

Certainly improve the chances.
