Hey Guys,

I'm new to this site and just have a couple question. I currently got married as in a week ago. I don't know but suddenly this site had made me very nervous to file my paperwork. My husband is in the military and we have a one year old son he got his cbra and us passport recently. This year makes 4 years since we are together but only married a week. it seems like I have to prove the validity of our marriage and that i might be turned down especially the 2 year stipulation. Should I wait a while for him to sign up the I-130 or not. I am currently being added into the military system. Please let me know or am I just nervous for nothing.

Congrats on your marriage and welcome to VJ.You can start filing as soon as possible, you have a child together so that's a big plus and you must have photos from your pass

welcome! u can start filing as soon as you guys have all the documents..that is marriage certificate.the 2years stipilations just mean u have to have seen each other in the past 2 years which clearly you have cos you have a one year old together.make sure to send copy of baby's crba,passport and ssn card. u can also request expedite based on military affiliation so get to it girl and goodluck!

Congrats on the wedding.. No worried on the time frame, there are lots of people that file at 1-2 months on here. I waited all of two weeks ;)

the 2years stipilations just mean u have to have seen each other in the past 2 years

That's only the case for K1 visas, there is not such stipulation for spousal visas.

Once the USC has the marriage certificate, the I-130 can be filed at any time.

Also, how much does this entire process cost? I thought it was just the $420 but it seems to me like there are other cost apart from the medical. How much should we budget for? I'm currently waiting on my passport which has my name changed and yes I will send all the baby documentation as well. Just super nervous cause I never know they could deny I-130 applications and I don't do well at interviews. always get too nervous and freeze up.

Well, you pay the I-130 fee= $420, the IV fee=$404, the AOS fee=$88, the medical and the vaccinations if needed. Then you should budget for the trip to interview, the stay (if you live outside of the city), and the flights.

that 2 year thing is only for K-visas not for someone with a wife/husband and having the baby isnt as much of a plus as many might that.. all it says is there was a sexual exchange. research how many have been denied EVEN having 2 children... since that says nothing about a valid marriage tho is helps somewhat.
