A friend a mine was denied visa in 2004 due to certain issues but used this name (Larry Smith and DOB is jan. 1st 1979. traveling to USA-no finger print done at the time).....within that same year, Larry's mother try to find another avenue for him by using another information ( Larry Bush and DOB is October. 29th, 1983. traveling to Canada. finger printed) both situations took place at the same Embassy. Now, Larry has an application I-130 in the system processing using the first information above which of course his mother just petition but Larry has found a girl who is sincerely in love with him and wants to marry him. How can this situation be handled? Please help cause I am very scared for him and don't want him to loose out on this. Is it okay for his Mother to cancel the application that is already file (Larry Smith DOB JAN 1ST 1979)?? PLEASE HELP!!!!!!!!!!!!!!!!!!!!!!

He's going to need a very, very good lawyer. Even if his mother withdraws the petition. I'm not sure which is his real name (it sounds like it's the second visa petition) but either way, one of those visa applications was blatantly fraudulent and there is no way he'll make it thru this process without a intense legal assistance.

Misrepresentation of any information to obtain a visa can result in a 5-10yr ban or lifetime ban. If she/he lied on any application for immigration purposes using false names or DOB then its lying...point blank... lifetime ban.

It may be possible to try a waiver but IDK how easy that would be... my suggestion is to get a lawyer on the ready... not sure how well this will work out.

I am not quite sure I understand, you mention travelling to Canada. Are you saying the second set of info- the wrong info- was used to obtain a Canadian visa, NOT in any US visa paperwork?

Why was he denied the first visa?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Are you saying the first attempt was to visit the USA and the second was to visit Canada? If so its not possible for it to be the same embassy as you stated. However, if the false name and DOB was through the Canadian embassy and not the American embassy then it will not be a problem because the name and DOB will be consistent. Please clarify your statement so we can better advise you.

The first time, it was the boy's dad trying to send for him to come to the USA through the American Embassy. The second time, it was the boy's Mom trying to help him out to go Canada using a whole different information. But the boy said that, both times it was done at the same embassy.

Actually, the second set of information was totally wrong. which is the one traveling to Canada. The paperwork has always beeen right but the thing is that, he went to the same embassy and was finger printed for the canadian visa and not the american visa.

There is no way it could have been processed at the same embassy. You go to the American embassy only if you are attempting to visit the USA and you go to the Canadian embassy only is you are attempting to visit Canada so it looks like there is definitely mis-information and you need to verify that before you can figure out the best way forward.
