i'm confused as to whether you can do the i864/ds 230 phase electronically or not. usc lives abroad and is applying through montreal. can both be done electronically? both by snail mail? combo of the two? usc originally started process in US but now resides in canada and continuing process from there.

Well, if the USC resides in Canada for over 6 months, you guys can do DCF. Otherwise - EP.

dirtpile,

From your post I understand that the process has already begun but the petitioner has moved since submitting your petition and is now residing in Canada. There is a great wiki on NVC processing for Canada. Fortunately we live in a country that lets you submit your documents electronically, huge time saver! :D

Here is the link to the wiki:

NVC for Montreal Beneficiaries Electronic Processing and New Online Forms

Hope this helps! And please :time:

Good Luck!

PS - I am following this guide too!

Yes, you can submit everything electronically (AOS and IV packages).

But remember, you're REQUIRED to fill out and submit the DS-260, an online form, similar to the DS-230.

MissDinaDee, above, suggested a wiki that I'd also highly suggest reading as I wrote it. It'll go over everything about EP (electronic processing) and the online forms.

If you have any questions after reading it, then don't hesitate to ask me, I'll be glad to answer!

Not anymore. Effective this Monday (8/15), if there is no USCIS field office in a country, then the I-130 will have to be sent to Chicago. Canada does not have a USCIS field office.

Was it posted on USCIS website?

It was, however, the public notice was amended this past Wednesday (8/10) that allows for some exceptions. I've linked to it below.

thanks for the help guys. i'll take a look.

2 other questions:

i assume i could do the beneficiaries work and send it along and later send along the AOS (my I864) and the ds260's would just sit and wait until then? or do they HAVE to be sent at same time?

does ds260 totally replace ds230 if doing EP or do you still have to do both.

everything else i think i'm finally clear on.

No, they don't have to be sent at the same time. The DS260 will just sit there till you send in your I864 and supporting documentation.

does ds260 totally replace ds230 if doing EP or do you still have to do both. You have to do both. First do the DS260, send it in with its supporting documents, and then Montreal will ask for the DS230 at the interview.

everything else i think i'm finally clear on.

I agree with your answers except for one tiny detail. The DS-260 isn't submitted WITH the supporting documents. It's completed online and submitted on its own. The supporting documents of the IV package are then emailed (if doing EP). The DS-260 isn't included in the IV package.

That's true. My apologies for a possibly confusing statement. :)

So are the supporting docs sent with the I864 (is this what is referred to as the IV package?)? OR are the supporting documents emailed on their own after filling out and sending the DS260 and then the I864 is filled out/sent later w/o the docs referred to in the wiki (i.e. passport pictures, BC, marriage Certificate, etc)?

The I864 is the Affidavit of Support, and it, along with its supporting documents (tax transcripts, bank statements, pay stubs, letter of employment and cover letter printed from payment portal) is scanned in and emailed.

The IV package supports the DS260, and includes the passport photos, BC, marriage cert; it is scanned and emailed to NVC as soon as possible after the DS260 has been filled out and submitted at the document portal.
