Hi,

I'm US Permanent Resident (Green card) holder and planning to get married next month in India. My would be is Indian citizen. I would like to know how long is the process taking now a days to get her here? I'm hearing its taking 5/6 months. Is it true? Any pointers would be really appreciated.

If anybody can suggest if it's good idea to approach a lawyer for this or file the papers on my own? Pls advise.

Hoping to get a reply.

Thanks

Good evening. The process when you petition some one as a geen card holder is up to 3 years. The 5 or 6 months might be for the initial approval from USCIS.

You got the time frame very wrong- there is wa waiting list for spouses of LPRs to get visas, so you'll be waiting about 3 years. No lawyer needed unless you have a complicated case- drug use, previous overstay etc. Have a look at the Guides here: http://www.visajourney.com/content/guides the process is the same for LPRs and US citizens, it is just longer for you as you will have to wait for her priority date before an interview is given.

Thanks for the information. Is it valid to try her tourist visa while her case is being processed? or try to see if we can get her Student visa (F1)? Pls advise.

Thanks

Yes you can try both/ either. It may be difficult for her to get approved for a tourist or student visa when she has a greencard holder husband, but it's worth a try. Just be sure to never have her overstay!
