So here's my situation.

My cousin just got married and both reside in the US. His wife is the US Citizen and she's petitioning to for him. He's never had a work permit, but was able to obtain a SSN and somehow work and pay taxes. Him and his wife, who is pregnant, will be filing for I-130 soon, will this be an issue? Since I know the immigration looks at everything.

I'm not sure what to advise them on this situation.

Thanks!

Her husband is working illegally. Plain, "vanilla" illegal work is overlooked for spouses of USC citizens for the AOS process, but other aspects of illegal work are not. Falsely claiming US Citizenship, forging documents in order to obtain a SSN one is not entitled to, or using a stolen or made up SSN will make him inadmissible and he will be deported.

AOS for my husband

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
