Hi All, To make this as short as possible...my wife Rosie is from China. K-1 approved, married Feb. 8th (within 90 days), 485 sent in but many mistakes made by attorney. Most of those we've worked through and we are now waiting for approval but I have this question. Our attorney told us that it was Ok for my wife's daughter to come here under the K-2 for a visit and then go back to England (where she's studying) and then we just go through the 485 proceedings as normal for her daughter when we want. Very untrue. Now her daughter must go the 130 route. My question. I was wondering if there is consideration given by the government for mistakes made by attorneys that so dramatically impact such things? I.E. will they give us another chance with the K-2? We were just going by what this attorney told us. Any thoughts?

Nope, no way around it. Thats why most people say do not use attorneys. Its unfortunate that you did not use/find VJ sooner because you would have gotten information for free and been doing the correct path for things and avoided this.

Nobody get's special dispensation just because their attorney screws up. It sucks, but that's the way it is.

I sure hope you fired that attorney. :whistle:

05/01/2013 - Removal of Conditions - APPROVED!

at most, can request expedite on the I-130 packet, in the cover letter you include with the I-130 submittal.
