hello. i am a permanent resident through my dad's petition and i came here aug 2007. Next year, i will be eligible to apply for citizenship.

i have a 4-5 year old son in my country and i am planning to apply for the I-130 for him, since the immigration office here in Chicago advised me to.

Is it wise for me to apply now for the I-130, should i wait for my citizenship next year or so, or should i apply a tourist visa for him (i'm not sure how), take him here and wait for him until he is naturalized?

please advise. thanks.

if you had filed for him as soon as you got here, he'd already be here. too bad you didn't. you can still file for him to start the ball rolling and when you become a USC, change your status and then he wom't have to wait anymore.

by the way, i also put him under the follow-to join paper. just to let you know. it has been four years that i have not really seen my son personally and there is little advice for me around.

Y0u c0uld have seen your child if. U wanted to. If your son should get here on a tourist visa he still wouldn't be able to gain naturalization thru you unless he has a qualifying status I.e. lpr.

You can apply for him now or when your new status is granted. He could enter as a us citizen which again changes nothing. Be sure to reestablish a relationship with the child for immigration reasons.

should i just apply for a I-130, wait for the NOA, then apply for the I-824?

I am 0n my phn and s0 can't fully reply due to phn issues. You're going to apply using the I130 which establishes a relationship between you and the child. If you apply now having a green card there will not be a visa number availabe to the child since he would not be considered to be your immediate relaative (IR).. so he would be classed. As F2A. Processing times in that category now.a.days is about 2 to 3 years.. on average so if. Things turn and the citizenship road is halted know that his case will be processed. The i864 will be. Requested/submitted at the nvc stage.. which all comes after the case being approved. Besure not to apply for the child should he come here if you're not a citizen... because he will not allowed adjustment to his status.

so youre saying, basically that i should apply for him when I have my citizenship and i become a US citizen? If I apply now for him, how and when do and should I adjust my status in the immigration and how will that affect my petition?

If you apply now you need not adjust your status... that changes with uscis/dos etc once you become a us citizen and you would be required to update uscis if they have your case, the nvc or the foreign consulate alike. If you apply now he will just get here quicker... since the priority date iis no where close it is to be assumed that the case would be sitting at the nvc awaiting the pd which would then resume quicker once you update the nvc the petition would then be upgraded.

ok then. i will get my son's i-130 going then.

My dad was confusing me a lot because he wants me to apply his grandson's i-130 when i am a citizen apparently because it will delay the papers when i apply right now as a LPR than apply as a citizen. so thanks for clearing that up for me. :blush:
