OK, here's my background.

My Husband is a US citizen. I came here with a visitor (B1/B2) visa and overstayed till it expired.

Me and my husband were together for 3 years and got married last year.

We filed i-130 last April of this year and was then approved. The i-797C NOA states that we must submit the 1-485 in order for me to adjust my status.

We are currently working on that, and almost done with it. However, now people are constantly telling me that I should get a lawyer to handle my case. Why? what are the chances we'll get denied? I mean I know theres always that chance. But do i "REALLY NEED" a lawyer? I mean, we were doing good so far. Then all of a sudden people start coming up to me and telling me that I better get a lawyer cuz if i get denied i will get deported and banned. Im almost considering getting a lawyer now...but we cant afford it...

06/02/2002: arrived in the US with B1/B2 visa (overstayed)

08/16/2010: wedding day

04/15/2011: submitted i-130 package (Chicago Lock box)

04/18/2011: received NOA-1 for i-130, check cashed

07/11/2011: received NOA-2 for i-130 approval

10/17/2011: submitted i-485 package (Chicago Lock Box)

10/26/2011: USCIS received payment/check cashed for i-485 package

10/31/2011: received NOA-1 for i-485 and i-765

11/03/2011: received biometrics appointment

11/18/2011: biometrics appointment

12/08/2011: received notice for failed biometrics

12/16/2011: walk-in biometrics (successful)

12/30/2011: EAD ordered and in production

01/03/2012: Received NOA for AOS interview

01/06/2012: Recieved EAD

02/07/2012: AOS interview day (APPROVED!)

They seem very confused and not so credible on yahoo answers. Overstay is irrelevant/forgiven for spouses of US Citizens. You would send the I-485 and accompanying forms with a copy of your I-130 approval notice (you could have filed them both at the same time this way works too). An issue of overstay alone does not warrant a lawyer, in my opinion.

If you have no other issues except overstay and can follow instructions and interpret things literally, then I see no need for a lawyer. You should be the judge of your own abilities. Good luck.

P.S. There are plenty of people here who adjusted with overstay without using a lawyer.
