Hi everyone,

I am new here so please forgive any stupid or constantly asked questions! :) Now I know this topic has been posted before but I like to try and get the latest info from people so at the risk of annoying people I have a question around visiting my Fiance on the VWP after we have submitted the K1. I know a lot of you out there have done so without problems and it is recommended that you take strong evidence of ties to come back home. I am planning on visiting mid-Sept for 3 weeks so would you say the following items would be evidence enough:

- Copy of mortage agreement?

- couple of bank statements?

- last 3 months wages slips?

Anything else advised that will strike the right cord with officials? I do have my return flight booked of course.

Also, is there any official US document that states it is okay to visit on a VWP as you go through the process?

Or alternatively is it better to apply for a tourist visa? Although I am not sure there is time now! :)

Yes, you can visit.

Seems like you have strong ties.

I am visiting in September too.

I am gonna bring the copy of our I-129f application with me to show them that we are going about the whole thing legally and I am not tryin to commit any fraud. Also thinking about getting a letter from my girlfriend stating that I am staying with her while I am there and they can come to her if I overstay.

Hope that will get me through!

Hi zoe,

you cannot apply for a tourist visa since you have a K-1 pending already. It would be useless anyway cause you're from a VWP country. I'm one of those who travelled without problems during the process and didn't have absolutely a single problem..and the only things I had with me were a copy of NOA1,my ESTA and my return ticket. CBP officer simply asked me when I was coming back and that's it. You shouldn't have a single problem especially if you carry with you the documentation you mentioned..but what I noticed after many trips in the US, is that the inspection carried on by CBP is 90% psycological.

They can spot if someone's nervous and hiding something with extreme ease..and if they get in their mind that there's something wrong,documentations can be of limited help. Be sure to say you're visiting your fiancèe..don't lie by claiming that you're there for a vacation or to visit a friend; T

Those that tried that nonsense way,found themselves on the first plane back home in more than one occasion. Things depend mainly if the officer had a bad day or if the person looks too nervous; you can only avoid the latter,and the reason is because you have absolutely no reason to be scared since you're doing things legally and you don't have immigration intent regarding this particular trip. They want to stop fraudsters and smartasses who thinks they're so bright they can easily cheat the system,not honest people :) You're gonna be fine :thumbs:

All looks good. If you could get a letter from your employer stating that you are due back on such and such a date that would strengthen things. Above all, always tell the truth to the CBP officer at Immigration control and you should be fine.

Just take as much as you can to prove your ties to UK. When my fiance contacted his congress rep about my visit, she contacted CBP on our behalf. They advised her that it is best for me not to visit US whilst I have a K1 pending as that automatically shows immigrant intent. When I got to my POE in Dublin, I was pretty much convinced that I would be turned back. I took a bundle of proof with me to show that I will return despite having a K1 in process. I had stuff like bank statements, letters from work, letter from a private clinic stating I am receiving some treatment etc etc The CBP officer asked me two questions: a) the purpose of my visit and b)If I was working at the time. He didnt look at the entire bundle I actually placed beside me, INFRONT of him. I was allowed entry and had the most amazing time! :dance:

my thoughts to you would be not to worry so much, just be honest and polite. They are actually nice people and they will look after you as long as you co-operate with them.

Thanks so much to all of you for taking the time to reply, I really do appreciate it. :) I know it is silly but I do get so nervous about this stuff because you hear all the horror stories don't you?!
