K-3 success?

I know that a lot of people say to not file a K-3....however, i already did and can't change that. So, what i want to know is if there is anyone who has filed a k-3 and it went through quicker than their i-130?? Thanks

I-130 Sent : 6/7/11

I-130 NOA1: 6/8/11

I-130 NOA2: 1/24/12

Interview: 5/14/12 (denied- but eligible for waiver)

I-601 Waiver Filed: 5/17/12

I-601 Waiver: acceptance notice received 6/24/12

I-601 Waiver: APPROVED - letter received 7/17/12

I-212: Submitted 10/9/12

I-212: APPROVED 10/29/12

VISA IN HAND- POE- Miami 11/28/12

Total time apart: 3 years, 10 months

Admin Review total: 3 months 3 weeks

Oh yes, years quicker! The k3 was designed to have the spouse be in the US quicker when the immigrant visa was taking years!

Now, that is simply not the case.

Now, when received at the same time, NVC closes the I129 petition leaving no alternative and no choice

Back in 2001 it saved years. In 2006, when my wife obtained a K3 visa, it saved about six months. Since 2007 it has at best saved a few weeks and at worst cost a few weeks. Beginning in February 2010 the sentence in bold above came into play but in the past few months we've seen three examples of USCIS forwarding I-129F petitions to NVC ahead of the I-130, resulting in keeping the K3 in play. Not sure if these are anomalies or indications of procedure change.

For the OP, there's nothing to do but wait and see what happens but you'll probably be wise to ignore the K3 and follow the CR1 path.

Simply wait now but I'd make sure you eventally apply for a cr1 visa

I filed BOTH an I-130 and an I-129F (af.ter i got NOA1 from i-130)

So, any damage is done. Your I-130 was pulled from its place in line and put back with the I-129F in its place in line. Nothing you can do to change that now. If you want the CR1, study the CR1 guide and NVC shortcuts, then get prepared to follow them. Ignore all correspondence regarding the I-129F. If by chance, your I-129F doesn't get administratively closed at NVC, decide which path you want and ignore all correspondence related to the other.

You will need to file a 130 for each of them.

Jamaica will not do a K3 if they receive the approved 130 petition before the approved 129 interview even if NVC doesn't close the 129. This I know for a FACT.

The Jamaican Embassy will hold your 129 up to wait for the approved 130.

If you mentioned the step children before, I missed it. Regardless of anything else, you need to file I-130 petitions for each step child as soon as possible. Even when K3 was viable, an approved I-130 was and is required for them to adjust status. IMO, it's always been best to file all the I-130 petitions up front, as it avoids delays in the spouse's adjustment of status. When filing the Children's I-130 petitions, send a letter asking that they be joined with the spouse petition. If too late, the cases can be joined at NVC.

Professionals who don't keep up with changes in the process, kind of piss me off.

I don't think it is always about keeping up, I think it's about taking short cuts financially. The K3 doesn't cost anything extra up front to file the kids, while the Cr1(130) filing is an additional cost for each 130 filed.

As they say if you don't pay it entering in the front door, you will pay twice as much existing out the back door. This is so true for the K3 visa.

yes, the kids are school age. we were planing on filing the i-130 for them after they got here, that way my hubby would be working and we would have the money to do it. :blink: i just don't have the money right now to file 3 additional i-130s :crying:
