confused bout k3!!

hi guys..well im so confused cuz i been reading here all the topic and theres this thread saying the k3 is close?whats that mean?meaning we cant apply for k3 visa anymore?well theres this all my question hopefully you guys can help me and clear bout this thing..really so confused and worried :(

first we cant apply for k3 visa anymore?

second is i130 and i129 should pass the same time or just i130 first and just wait for the uscis reply?

just need help so everything will be clear for me..thanks guys..

hello.....this is just my opion but the need for a K-3 now i fell isnt really nessary if you are fileing it solely to come here faster.. if you read the guides carefully and with uscis and nvc processing IR-1/CR-1 vise at a faster rate then in the past,and the added cost for the K-3 and your have to adjust after getting here, well for us it wasnt worth it..............AS a side note if you look at my timeline your'll see i filied a CR-1, well my brother filied a few days after me but attacked a K-3 to his.....we go to our interview in just a few weeks and he is still stuck in the process, but you have the right to file any way you like, just read more and you'll pick the right road........ :thumbs:

02/14/2011... touched ( it must have fallen on the floor )..hehe
05/12/2011...NOA-2 OMG...98days u kidding me!!!!!!!

05/28/2011... receive DS-3032 in e-mail/e-mailed the DS-3032 back
05/28/2011... receive AOS fee bill/ and paid online.
06/01/2011... AOS fee bill shows paid.
06/02/2011... DS-3032 accepted
06/03/2011... IV-bill generated and sented by e-mail
06/04/2011... Paid IV fee bill/ in progress
06/07/2011... IV fee bill showed paid/ downloaded cover sheet
06/08/2011... Express mail both the I-864(AOS) and DS-230
06/09/2011... Confirmed del at 11:10am signed by N visa center.
06/21/2011... SIF...yea!!! called NVC..yes case complete but no interview dates until aug..rats!!
06/28/2011... issured interview date set for 08/08/2011 At 6:30am.

thank you for all the reply,but im still confused if the I-130 and I-129 approve at the same time we can apply for CR1,but we just I130 and we didnt send the I129 cuz we waiting for NOA..so if we will apply for CR1 should we send the I129 too now?im sorry im just so confused cuz i dont have idea bout this all..ive been reading all the link that ya'll guys gave to me lol but i still need further explanation,hope you guys understand thanks..:)

Map out the time ticks between each event, for each visa type.

Use the timelines here for a CR-1 homed to yer country, study them.

Or - let me throw some timeticks for you, yes?

Let's say you get the I-797-C, the receipt notice on the I-130.

You decide to send in the I-129F.

Weeks go by, finally the I-129F is acknowledged, a receipt notice given. The I-130 is yanked out of it's current queue, pushed BACK to the entry in queue of the I-129F, and a new clock starts. Whoops - there went 2 to 8 weeks. Gone. Irretrievable. You just lost 2 to 8 weeks - how do you feel?

Push forward to the approval date. USCIS, due to background check automation and FBI fast-clearance, approves the I-130 and I-129F on the same day. So far, you've lost 2 to 8 weeks. USCIS sends off both casefiles to NVC, in the same packet, same day. 99 percent of the I-130/I-129-F casefiles are approved on same day, travel together to NVC.

NVC receives the approved I-130 and the approved I-129F same day, since they travelled together. Whoops ! Yer basis for a K-3, an unapproved I-130, doesn't exist anymore - so...

NVC administratively closes the I-129F - it's dead, as far as yer concerned. You've lost 2 to 8 weeks putting an I-129F in play, and are suddenly 'forced' to deal with NVC processing for a CR-1 visa - which takes 5 to 11 weeks to push through - should you follow LingChe's NVC shortcuts on the VJ Wiki system.

So - what did you gain, for the I-129F, for the K-3 visa ?

Going forward, the USCitizen Petitioner must deal with NVC for that approved I-130, as you really want an Immigrant Visa - the K-3 is not an immigrant Visa at all - it's some stop gap measure that WORKED 6 years ago, to get you here within a year. If you actively had a K-3 visa in play, you'd be spending another 350 at yer Embassy, plus another 1070 before you got a green card.

If you stick with the CR-1 visa route, the USCitizen petitioner pays 88 + 404 to NVC during NVC processing, and that's it - yer done with fees - no need for the Adjustment of status fees (again, that's 1070) and yer able to work in the USA within 3 weeks of hitting a Port of Entry in the USA.

I dunno - I'll suggest to you that your current background of knowledge is based on what other people have told you. 5 years ago, this would have been useful. Today? The information given to you is outdated, not current with the current timeframes and time ticks.

IMO, it's still up to yer USCitizen Spouse to decide what to file for you, depending on what is useful once you hit USA soil. IMO, it's not enough that you come to USA - you must join in, become a member of society. You can't do that with a K-3 visa, as you aren't allowed to work legally on a K-3, and it's a huge amount of extra work and extra fees to get a green card after you've arrived in the USA.

thank you for your reply ms.darnell really glad for all the reply..now i will just convince my husband to do CR1 then k3..:)

well have him talk to my brother......... :whistle: he filed 3 days after mine (with a lawyer who insteaded that the K-3 will get her here quickier) as u can see my timeline we go to interview in 3 weeks..........his vise just now shows up at NVC, my wife will be here at least a month before his, and i filed all mine by myself... if you even look at the USCIS website under processing times the I-130/CR-1 is 5 months....the I-129F/K-3 is 5 months so why muddie the waters with a K-3?? good luck!!

i will talk to my husband bout it that after we get the noa1 he shouldnt send the i129..but i think he put k3 in the i130 that he send..so i will just hoping that we can expedite everything too..thanks..:)

I don't wish to muddy the waters either but USCIS doesn't issue visas. If there's time to save now by taking the K3 route that time is saved AFTER the petition is approved. USCIS processing time is the same BECAUSE they process the two petitions together.

Facts are cheap...knowing how to use them is precious...
