Please search the MENA regional forum for returned petitions, it has all the detailed info you will need to proceed. You must act quick. If the petition has been returned, either you will have a second chance to give your rebuttal after you will get the exact reason for denial or it will expire, at which time starting over is better than a costly and lengthy appeal. This will be a time consuming journey either way.

Try to keep the petition at the foreign post and contact the CO yourself and through your senator.

Ask your fiance for every detail from the interview, every question, no matter how small.

Notarized letters from family and friends attesting of your genuine relationship will also be helpful. This is not a document issue, this is a relationship issue. If documents were missing they would request them on the 221g paper, same goes for them needing additional relationship evidence.

Was he able to answer every question in the interview ?

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

To answer a few other points raised in this thread = Jamaica does not allow the petitioner to attend the interview= so being how close JA is to the US is irrelevant - on top of which, distance doesn't make a difference, ticket prices are nearly double right now. If they want to interview the petitioner, they will blue slip for them to come back. Secondly, any additional evidence (financial, phone records, etc...) they would blue slip for.

I am so sorry you are going through this but I agree with the above advise - do not wait to see what response you get before contacting your senator, you need to be proactive not reactive and fight to keep your petition in JA before it gets lost in a hole somewhere - contact anyone and everyone you can, and keep doing so until you get an answer.

I am so sorry you are going through this but I agree with the above advise - do not wait to see what response you get before contacting your senator, you need to be proactive not reactive and fight to keep your petition in JA before it gets lost in a hole somewhere - contact anyone and everyone you can, and keep doing so until you get an answer.

When I contact my congressman do I just tell them the situation of my case and/or do I ask them to call Jamaica? I know a few people that work for the congressman so I shouldn't have a problem with that.

:ot: Oh I wanted to tell everyone about the mean lady that I spoke to from DOS this morning. I was calling because yesterday they told me to call back today to see if they had a reason for a the refusal in the system 3 people to me that yesterday. So I call back this morning and get this

Her: hello how can I help you

Me: can I give you my case number Kng**********

Her: I see there was an interview yesterday and its been Denied What did they tell him? It will be sent back to USCIS and they will contact you.

Me: I called yesterday and they told me that a refusal and a denial were different. Does it say Refused or denied? And is there a reason why?

Her: NO there isn't and they are the same look! I have been working her 10 years I know what I'm doing.

Me: Well can I talk to someone else maybe your manager. Who can explain why?

Her: Sigh if you want to talk to someone else hang up and call back. "click"

That was very rude. I never got her name so I can't complain about her oh well.

I would tell your congressman EVERYTHING - tell them the run around you are getting, etc... - let them place some calls and see what they can find out - In the meantime, keep calling and emailing yourself -

I would tell your congressman EVERYTHING - tell them the run around you are getting, etc... - let them place some calls and see what they can find out - In the meantime, keep calling and emailing yourself -

dang.. that was harsh wasnt it.... I'd spoken to some mean Immigration Officers At USCIS.. but still treated them like regular reps... wont ever settle

I got in contact with my congressman’s rep today and he will call me back later so I'm being proactive about this. I do not want it to come back here it's going to expire on the 28th of July so I know they will let it sit until it expires. When I called USCIS they told me when it gets back to them they will contact me in 120days after they receive it which is ridiculous and I surely don't want that.
